A reader asked a question with the content: "I am married to a foreign husband, so I would like to ask if I am eligible to buy social housing?"
Responding to the above question, the Department of Housing and Real Estate Market Management responded as follows:
On June 29, 2023, the National Assembly passed Housing Law No. 27/2023/QH15, effective from August 1, 2024.
Clause 7, Article 2 of the 2023 Housing Law stipulates: "Social housing is a housing with State support for beneficiaries of housing support policies according to the provisions of this Law"; the beneficiaries of social housing support policies have been stipulated in Article 76 of the 2023 Housing Law.
Social housing buyers in addition to the above-mentioned housing support policy beneficiaries must also simultaneously meet housing conditions and income conditions (in Articles 29 and 30 of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government detailing a number of articles of the Housing Law on the development and management of social housing).
In case the plaintiff is married according to the provisions of law, the plaintiff and his/her wife (husband) with a total monthly income shall receive no more than 30 million VND in salary according to the salary table as confirmed by the agency, unit, or enterprise where the subject works.
