Pursuant to the provisions of Clause 5, Article 76 of the 2023 Housing Law, it is stipulated as follows:
Article 76. Subjects entitled to social housing support policies
1. People with revolutionary contributions and relatives of martyrs who are eligible for support to improve their housing according to the provisions of the Ordinance on Incentives for People with Revolutionary contributions.
2. Poor and near-poor households in rural areas.
3. Poor and near-poor households in rural areas are often affected by natural disasters and climate change.
4. Poor and near-poor households in urban areas.
5. Low-income people in urban areas.
6. Workers and laborers working at enterprises, cooperatives, and cooperative unions inside and outside industrial parks.
Pursuant to Clause 2, Article 30 of Decree 100/2024/ND-CP amended by Clause 2, Article 1 of Decree 261/2025/ND-CP (effective from October 10, 2025) stipulates as follows:
Article 30. Income conditions
1. For subjects specified in Clauses 5, 6 and 8, Article 76 of the Housing Law, the following income conditions must be ensured:
a) In case the plaintiff is unmarried or confirmed single, having an actual average monthly income of not more than 20 million VND shall be received according to the Salary and Salary Table confirmed by the agency, unit or enterprise where the subject works.
In case the petitioner is an unmarried person or is confirmed to be single and raising a child under the age of majority, the actual average monthly income received shall not exceed 30 million VND as calculated in the Salary Table, confirmed by the agency, unit or enterprise where the subject works.
b) In case the plaintiff is married according to the provisions of law, the plaintiff and his/her husband (husband) with a total average monthly income shall receive no more than 40 million VND in equity according to the Salary and Salary Table confirmed by the agency, unit, or enterprise where the subject works.
c) The time to determine income conditions as prescribed in Point a, Point b of this Clause is within 12 consecutive months, calculated from the time the competent authority implements the confirmation...
2. In case the subject specified in Clause 5, Article 76 of the Housing Law does not have a Labor Contract, it must ensure the income conditions as prescribed in Clause 1 of this Article and be confirmed by the police agency at the commune level where he/she is residing or temporarily residing or currently residing.
Within 7 days from the date of receipt of the confirmation request, the police agency at the commune level where the subject is residing or temporarily residing or at the time the subject requests confirmation shall base on the information of the population database to confirm the income conditions.
Thus, if freelancers do not have labor contracts, they can be low-income people in urban areas.
Accordingly, freelance workers who want to buy social housing their income is determined as follows:
- Not more than 20 million VND/month if single.
- If you are not married or confirmed to be single and raising a child under the age of majority, the average monthly income actually received shall not exceed 30 million VND.
- The total income of the single person and the wife (husband) is not more than 40 million VND/month if they are married.
Even if there is no labor contract for low-income people in urban areas with real income received by the commune-level police where they are permanent or temporarily residing or where their current residence is confirmed to be eligible, they can buy social housing according to regulations.
In addition, it is necessary to meet the regulations on housing conditions according to Article 29 of Decree 100/2024/ND-CP as follows:
(1) The case of not having a house under their ownership is determined when the subject specified in Clause 1, Article 77 of the 2023 Housing Law and the husband or wife of that subject (if any) are not listed in the Certificate of land use rights and ownership of assets attached to land in the province or centrally-run city where there is a social housing project at the time of submitting the application for registration to buy or rent-purchase social housing.
