What are the works directly serving agricultural production?
Pursuant to Clause 6, Article 3 of Decree 112/2024/ND-CP, the regulations on works directly serving agricultural production are as follows:
- Constructions directly serving agricultural production are constructions serving preliminary processing and preservation of agricultural products; warehouses containing agricultural supplies, machinery, labor tools; displaying and introducing agricultural products.
Thus, the project directly serving agricultural production is a project serving the preliminary processing and preservation of agricultural products; warehouse for agricultural supplies, machinery, labor tools; display and introduction of agricultural products.
What conditions must be met to build works directly serving agricultural production on rice-growing land?
Pursuant to Article 9 of Decree 112/2024/ND-CP, which stipulates the construction of works directly serving agricultural production on rice-growing land as follows:
Article 9. Construction of works directly serving agricultural production on rice-growing land
1. The provincial People's Committee stipulates the area, location, and purpose of use of construction works directly serving agricultural production on rice-growing land, ensuring compliance with the following conditions:
a) Not affecting irrigation works, dykes, intra-field traffic, and adjacent rice-growing land;
b) The project is only allowed to have 1 floor, not a basement;
c) The area of rice-growing land allowed for construction must be concentrated, with a minimum area of 50 hectares;
d) Construction works serving the purpose specified in Clause 6, Article 3 of this Decree.
2. The construction of works directly serving agricultural production on rice-growing land shall comply with the provisions of the law on construction and other relevant laws.
3. The land area for construction works as prescribed in this Article does not have to be converted to other land use purposes and is still counted as rice-growing land.
Thus, the Provincial People's Committee stipulates the area, location, and purpose of use of construction works directly serving agricultural production on rice-growing land to ensure compliance with the following specific conditions:
- Does not affect irrigation works, dykes, intra-field traffic, and adjacent rice-growing land;
