The People's Council of Ha Nam province has just issued Resolution 16/2024/NQ-HDND stipulating the criteria for deciding to conduct bidding to select investors to implement investment projects using land (investment projects to build urban areas with mixed-use functions, synchronous technical infrastructure systems, social infrastructure with housing according to the provisions of the law on construction for new construction or renovation, urban embellishment, rural residential area projects) in Ha Nam province according to the provisions of Point a, Clause 1, Article 126 of the Land Law.
According to the Resolution, investment projects to build urban areas and rural residential areas shall conduct bidding to select investors when fully meeting the following criteria:
Firstly, it is a case where the State reclaims land according to the provisions of Clause 27, Article 79 of the Land Law.
Second, area scale: Urban areas according to the provisions of the law on construction; Rural residential areas have a land use area of 3 hectares or more.
Third, for land that has not completed compensation, support, and resettlement. In case the land area for project implementation includes a part of land specified in Clause 1, Article 217 of the Land Law and does not meet the conditions for separation into an independent project according to the provisions of the law on land, a bidding process will be conducted to select an investor to implement the project for the entire land area.
The People's Council of Ha Nam province also assigned the Provincial People's Committee to organize the implementation of this Resolution. During the implementation process, if the contents stipulated in this Resolution are not consistent with the provisions in documents issued by central agencies after the effective date of this Resolution, the implementation shall be organized in accordance with the provisions in documents issued by central agencies.
At the same time, the report proposes that the Standing Committee of the Provincial People's Council consider and approve to submit to the Provincial People's Council to adjust, amend and supplement the Resolution at the nearest session to ensure compliance with legal regulations.
