On November 30, the People's Committee of Dong Anh district (Hanoi) announced that it had organized compulsory land recovery to implement the project of building technical infrastructure for land plot X5, Phong Chau village, Lien Ha commune, to serve the auction of land use rights.
According to the People's Committee of Lien Ha commune, the X5 land plot originated as agricultural land, allocated to 49 households according to Decree No. 64. During the production process, people have converted the crop structure.
In fact, some households have encroached, misused, and violated construction regulations on agricultural land. Many areas have been built into solid structures and are no longer used for agricultural production.
In 2020, the People's Committee of Dong Anh district issued a decision to compensate and reclaim this land to implement the project of building technical infrastructure, serving the auction of land use rights. The total project area is 3.5 hectares.
During the process of compensation and site clearance for project implementation, only 19 households voluntarily handed over the site and received compensation.
The remaining 30 households did not agree to hand over the land because they believed that the compensation level of the local government was not satisfactory according to regulations.
Regarding this issue, a representative of the Department of Natural Resources and Environment of Dong Anh district said that according to regulations, the compensation level for agricultural land recovery in Hanoi is 135,000 VND/m2 and there is 5 times more support for the area used for agricultural production only (equivalent to 290 million VND/Northern sao; 1 sao is 360m2).
However, the entire land area of 30 households that had to be forcibly recovered was used for the wrong purpose and was no longer used for agricultural production; at the same time, people had arbitrarily built solid structures, so when compiling compensation records, the local government could not implement a 5-fold support mechanism, but had to maintain the original level of 135,000 VND/m2.
According to the People's Committee of Dong Anh district, after completing the site clearance, the construction unit will organize leveling, construction of roads, drainage systems, water supply, electricity supply, fire prevention and fighting, trees... to serve the auction of land use rights.
