On February 1, informing reporters of Lao Dong Newspaper, a representative of Hung Luan Production and Trading Co., Ltd. said that they had sent a complaint against the Conclusion of Dong Loc Commune People's Committee (Nghe An) on determining the origin of land and handling the site clearance for the company's foam factory project at Truong Thach Industrial Cluster.
According to the dossier provided by the enterprise, in Report No. 142/BC-UBND dated October 20, 2023 of Nghi Truong Commune People's Committee (land management unit before adjusting administrative boundaries), the current status of land plots within the planning scope of Hung Luan Company's foam factory project (Truong Thach Industrial Cluster) is clearly identified as land not allocated to anyone for use, with only some perennial trees planted on both banks.

This report also affirms that the entire land plot belongs to sand dune land managed by the Commune People's Committee, has not been allocated to any individual for use; Mr. Nguyen Duy Binh's household is not named in the cadastral book, land register and is not allocated land according to regulations.
However, in January 2026, Dong Loc Commune People's Committee issued Conclusion No. 01/KL-UBND, which confirmed that the above land plots were "used stably and continuously for agricultural production" and oriented the project implementation to be implemented in the form of agreements with households currently using land.
According to the business, these two documents show a direct contradiction in the current status of land use: one side identifies wasteland, not for production; the other side confirms stable and continuous use, even without legal papers on land use rights.
Affirming it is public land but requiring businesses to agree


Notably, in the 2026 Conclusion, Dong Loc Commune People's Committee still identified land plots under the management of the Commune People's Committee, people without land use right certificates, land belonging to the planning of Truong Thach Industrial Cluster. However, the local government requested the enterprise to negotiate with households to have land to implement the project.
The business believes that this is a major contradiction: if the land is under the management of the Commune People's Committee, and people do not have legal papers, then forcing the business to agree with the land user will transfer the State's land management responsibility to the investor, while land law does not allow legalizing the act of using land that is not allocated, leased or recognized.
The Commune People's Committee has both identified the land as public land under its management and recognized the current status of use of some households, and then requested the enterprise to agree to have land. This has put the enterprise in a deadlock without a way out," a representative of Hung Luan Company stated in the complaint.
Talking to a reporter of Lao Dong Newspaper about the incident, the leader of Dong Loc Commune People's Committee said that the incident had been resolved according to the correct procedure, ensuring caution, objectivity, and closely following current regulations.
As Lao Dong Newspaper has reported, the Hung Luan foam factory project in Truong Thach Small Industrial Park, Nghi Loc district (now Dong Loc commune) was approved for investment policy by the People's Committee of Nghe An province from August 8, 2022, with an area of more than 4,400m2, producing EPS panels, foam boxes, foam trays for food, with a capacity of 420 tons of plastic granules/year. The enterprise has been granted an environmental permit and completed the necessary technical procedures to start construction.
However, after 4 years, the site has not been handed over. The reason is that a household has not agreed to the compensation plan and has planted trees on the land belonging to the project planning.
Prolonging the above situation makes it difficult for businesses, affecting production and business plans.
