On the Information System for receiving, handling feedback and recommendations on legal documents, Mr. P.N.H.S sent a feedback related to Decision No. 29 dated October 28, 2024 of the People's Committee of Khanh Hoa province on the conditions, size and minimum area for land division and consolidation.
The Department of Agriculture and Environment of Khanh Hoa province has responded to people's petitions regarding the content related to the provisions in Point b, Clause 2, Article 4 of Decision 29.
Accordingly, "Land plots in areas where there is a Notice of Land Reclaimment or a Decision on Land Reclaimment by a competent State agency; except in cases where it has been more than 3 years since the date of the Notice and Decision but have not been implemented".
The Department of Agriculture and Environment of Khanh Hoa province has clarified: This regulation aims to handle cases of slow project implementation, despite having a land recovery policy, while protecting the legitimate rights and interests of land users.
If a plot of land has been notified or a Decision on land recovery, but after 3 years from the date of issuance, there are no implementation activities related to land recovery, such as:
If the inventory is not organized; compensation plan is not established or issued; compensation decision is not issued or land recovery is not carried out in practice, then the land user is allowed to continue to exercise its legal rights according to the law, including land division, transfer, mortgage, etc.
