Mr. P.D.D in Hue asked, if Mr. A has an open-ended plot of land that has been built with stable housing since 1999, will it be determined to violate land law or not?
It is known that according to the cadastral records, the land plot belonging to Mr. A's right to declare and register for use in 2003, the purpose of use is urban residential land and land for perennial crops.
Mr. D asked, now if Mr. A wants to propose to issue a red book, according to the provisions of Article 138 or Article 139 of the 2024 Land Law?

The application of policies to review and issue certificates to households and individuals using land needs to be based on each specific case and needs to be based on local land management records. The Ministry of Agriculture and Environment has the following principles:
The current land law has provisions on the issuance of certificates of land use rights and ownership of other assets attached to land for the first time to individuals and households currently using land in Articles 137, 138, 139, 140 and 141 of the 2024 Land Law.
The order and procedures for first-time registration of land and assets attached to land for individuals, communities, and households currently using land and the order and procedures for granting certificates of land use rights and ownership of assets attached to land are stipulated in Section II and Section V, Part C, Appendix I issued with Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government regulating the determination of the authority of local authorities at 2 levels, decentralization and delegation in the field of land.
The issuance of initial certificates to households and individuals is under the authority of the Chairman of the People's Committee at the commune level (according to the provisions of Point b, Clause 1, Article 5 of Decree No. 151/2025/ND-CP).
The Ministry of Agriculture and Environment informs citizens to know, research, and contact competent authorities in the locality for settlement according to regulations.
