In the petition sent to Hai Phong City Police, Mr. Do Van Huu accused 6 people related to transactions and land sales in village 7, Kien Bai commune, the old Thuy Nguyen district, now Thien Huong ward, Hai Phong city).
Mr. Huu explained that in 2024, his family had no place to eat or live, so they asked a woman named N.T.H (in the same locality) to buy a small piece of land to build a house. In August 2024, this woman informed Mr. Huu about someone selling a 60 m2 plot of land in village 7 for 550 million VND, including taxes and fees according to regulations.
Immediately afterwards, Ms. N.T.H transferred 50 million VND as a deposit to buy the land to the land owner. Mr. Huu said that due to lack of housing and lack of legal knowledge, he immediately broke ground after depositing the money and built a house on lot No. 2 from the beginning of the alley (current location of the house built incorrectly).
Mr. Huu affirmed that during the month of house construction, no one came to receive the land plot they owned, there was no lawsuit. The local government also did not prohibit or have a record showing illegal construction and the landowner did not make any recommendations.
At the end of September 2024, a group of people came to inform Mr. Huu that they had mistakenly built a house on the land of Ms. Tran Thi Kim Loan, who had deposited to buy it. A few days later, Ms. Loan and a group of others went to the notary office to complete the procedures to transfer the land plot that Mr. Huu was building a house on.
Knowing this information, on September 26, Mr. Do Van Huu and his wife also went to the notary office to complete the procedures to transfer the land lot that he had deposited to buy. However, because they trusted the broker and at that time at the end of the day, the couple did not read the contract carefully and sign immediately to transfer the documents to the old Thuy Nguyen District Branch Land Registration Office to carry out procedures for granting a right to use.
Only after November 18, 2024 did the People's Committee of Kien Bai commune invite Mr. Huu to work with the reason that he had mistakenly built a house on the land of Ms. Tran Thi Kim Loan. At this time, Mr. Huu and his wife found out that the land they bought was owned by Mr. N.C.H (in the old Kien Bai commune) and not by the group of brokers and sellers who introduced the land before. At the same time, Mr. Huu also learned that the value of the land lot that he and his wife spent 550 million VND to buy was only worth 100 million VND (the price in the land transfer contract).
Mr. Huu said that the group of land brokers appropriated 450 million VND from the difference in his land sale and showed signs of "tax evasion" to pay to the state budget. Therefore, Mr. Do Van Huu submitted a petition to the Investigation Police Agency of Hai Phong City Police to report the crime.
Previously, as reported by Lao Dong, the City People's Court has just issued a decision to suspend the appeal trial of a civil case on "District of land use rights and forced demolition of illegal construction works" because the plaintiff, the defendant Mr. Do Van Huu, and the authorized representative of the defendant, Ms. Vu Thi Tuyen, submitted a petition to voluntarily withdraw all the appeal. Ms. Tran Thi Kim Loan - the owner of the wrongly built plot of land - said that it is expected that on the 20th of the 9th lunar month, Ms. Loan's family will break ground to build a house on the plot of land next to the plot that Mr. Do Van Huu was accidentally building. Ms. Loan's family also notified the local authorities to persuade Mr. Huu's household to be informed and urgently relocate from the mistakenly built land.
