Speaking to Lao Dong Newspaper reporters on November 8, Mr. Phan Hung Cuong - Deputy Head of the Land Management Department (Department of Natural Resources and Environment of Ben Tre province) - said that up to now, the whole Ben Tre province has about 10,000 pending land records that have not yet responded to the people. The reason is due to the stage of applying land prices to determine financial obligations regarding land.
Mr. Cuong said that, implementing the direction of Official Dispatch No. 7456 dated November 6, 2024 of the People's Committee of Ben Tre province, the Department of Natural Resources and Environment has sent an official dispatch to the Provincial Tax Department and related units to coordinate in handling tax calculation to quickly resolve outstanding records related to the performance of financial obligations on land.
“After people fulfill their financial obligations regarding land, the competent authorities will issue certificates of land use rights, house ownership rights and other assets attached to the land to the people,” said Mr. Cuong.
Since the 2024 Land Law took effect, when people transferred land use rights, due to the congestion in tax calculation, the authorities in Ben Tre have not responded to the results of handling the records for the people, leading to a large backlog of land records.
Mr. Nguyen Van Tuan (name has been changed) said: “At the end of September 2024, my wife and I went to the Ben Tre City Land Registration Office branch to receive a notice of financial obligations regarding land. At that time, an official of the Ben Tre City Land Registration Office branch replied that due to congestion because the tax had not been calculated, my land records were currently “suspended” and had not been resolved,” said Mr. Tuan.
To solve the above problem, on November 6, Ben Tre Provincial People's Committee issued Official Dispatch No. 7456 on continuing to apply the issued land price list to determine financial obligations for land in the province.
According to this document, the People's Committee of Ben Tre province requests relevant departments, branches, localities and units to continue applying the land price list in Ben Tre province according to the 2013 Land Law for the period 2020-2024 and the land price adjustment coefficient issued by the Provincial People's Committee in Decision No. 20/2024. The application period is from August 1, 2024 until the Provincial People's Committee issues the adjusted land price list according to Clause 1, Article 257 of the Land Law.
“The People's Committee of Ben Tre province assigned the Department of Natural Resources and Environment to coordinate with relevant departments, branches, localities and units to organize the development of an adjusted land price list according to Clause 1, Article 257 of the Land Law in accordance with the provisions of Article 17 of Decree No. 71/2024/ND-CP dated June 27, 2024 of the Government regulating land prices.
The Provincial Tax Department, the Department of Natural Resources and Environment and relevant sectors, according to their functions and tasks, urgently resolve the backlog of financial obligations of land users. Strictly coordinate between agencies and units in handling administrative procedures, creating favorable conditions for taxpayers. Proactively coordinate with relevant sectors to resolve problems arising in the process of collecting financial obligations related to land, ensuring proper authority, compliance with legal regulations, and no congestion" - Official Dispatch No. 7456 of the Ben Tre Provincial People's Committee clearly stated.
