The Ministry of Agriculture and Environment received a petition from voters of Hanoi City sent by the National Assembly's Committee for Petition and Supervision with the content: "Voters request that after the arrangement of local governments at 2 levels, it is necessary to pay attention to directing and implementing Resolution No. 19-NQ/TW dated June 16, 2022 of the Party Central Committee on Agriculture, Farmers and Rural Areas to 2030, with a vision to 2045, to promote the contribution of nearly 18 million agricultural workers, at the same time, to parallel with Resolution No. 68-NQ/TW dated May 4, 2025 of the Politburo on private economic development, creating breakthroughs in development in the coming period of the country.
In particular, there needs to be a policy to protect land for rice cultivation, improve the lives of farmers, so that farmers can grow rice with peace of mind, ensuring sustainable national food security".
Regarding this proposal, the Ministry of Agriculture and Environment has the following opinion: To orient and promote the development of agriculture and rural areas, on June 16, 2022, the 5th Conference of the Party Central Committee (term XIII) issued Resolution No. 19-NQ/TW on agriculture, farmers and rural areas to 2030, with a vision to 2045. To implement Resolution No. 19-NQ/TW, the Government issued an Action Program in Resolution No. 26/NQ-CP dated February 27, 2023.
After more than 2 years of implementing Resolution No. 26/NQ-CP; specific goals and tasks have been and are being implemented on schedule and ensuring quality and efficiency; many mechanisms and policies have been amended, supplemented, promulgated, and outstanding such as the Land Law, which was voted by the 15th National Assembly at the 5th extraordinary session, amended and supplemented in the direction of promoting land accumulation and concentration to develop the land use market in agriculture, encouraging concentrated, large-scale agricultural commodity production...
Regarding the protection of rice-growing land and ensuring food security is a consistent policy of the Party and State of Vietnam. institutionalize the spirit of Resolution No. 18-NQ/TW dated June 16, 2022, at the same time inheriting the provisions of land law through the periods, current land laws continue to stipulate strict protection, management and use of rice-growing land, specifically:
(1) The content of provincial-level land use planning includes zoning of land-using areas that need to be strictly managed: rice-growing land, special-use forest land, protective forest land, production forest land that is natural forest (Point d, Clause 2, Article 65 of the 2024 Land Law);
(2) When converting the purpose from rice-growing land to another purpose, the land user must ask for permission from the competent state agency (Point a, Point b, Clause 1, Article 121 of the 2024 Land Law);
(3) Individuals who do not directly produce agriculture and receive transfers or gifts of rice-growing land use rights exceeding the limit prescribed in Article 176 of the 2024 Land Law must establish an economic organization and have a rice-growing land use plan approved by the Chairman of the People's Committee at the commune level, except in cases where the recipient is an heir (Clause 7, Article 45 of the 2024 Land Law, Point a, Clause 1, Article 5, Decree No. 151/2025/ND-CP);
(4) Economic organizations receiving the transfer of agricultural land use rights must have an agricultural land use plan approved by the Chairman of the People's Committee at the commune level (Clause 6, Article 45 of the 2024 Land Law, Point a, Clause 1, Article 5 of Decree No. 151/2025/ND-CP).
To effectively exploit and use agricultural land, improve the lives of farmers, and ensure sustainable national food security, at Point a, Clause 1, Article 218 of the 2024 Land Law, which stipulates "agricultural land used in combination with commercial, service, livestock, and medicinal plant cultivation purposes", this regulation includes the multi-purpose use of rice-growing land for commercial, service, animal husbandry, and medicinal plant cultivation purposes.
At the same time, Clause 2, Article 182 of the 2024 Land Law stipulates that the State has policies to support and invest in building infrastructure, applying modern science and technology for high-yield and high-quality rice growing planning areas; protecting rice-growing land, limiting the conversion of rice-growing land to non-agricultural purposes.
In addition, the Government issued Decree No. 112/2024/ND-CP dated September 11, 2024 detailing regulations on rice-growing land, specifying a number of policies to support local rice production such as supporting 1,500,000 VND/ha/year for specialized rice-growing land and 750,000 VND/ha/year for remaining rice-growing land, and supporting an additional 1,500,000 VND/ha/year for specialized rice-growing land in high-yield, high-quality rice-growing planning areas (Clause 1, Article 14)...
According to the Ministry of Agriculture and Environment, the above policies show the concern of the Party and State in protecting rice-growing land, improving income and life of farmers, and at the same time encouraging economic sectors, especially the private economy and the collective economy, to participate in the process of restructuring and developing agriculture in a sustainable and modern direction, contributing to ensuring national food security and creating breakthroughs for the country's development.
