The People's Committee of Phu Quoc Special Zone (An Giang) has just issued a notice on land declaration and registration; encroachment and occupation of land managed and used by State agencies and organizations for the wrong purpose.
According to the People's Committee of the special zone, in recent times, the situation of encroachment and occupation of land managed by State agencies (forest land, land in the sea corridor, rivers, streams, etc.) has become complicated. At the same time, through inspection, the land management agency discovered that there were many cases of dishonest declaration of land use origin, using documents with signs of fraud in land declaration, registration and issuance of first-time land use right certificates.
Accordingly, providing dishonest information about the origin and time of land use; submitting documents with illegal documents, documents without sufficient legal basis, forged documents or transfer documents not confirmed by competent authorities; arbitrarily making handwritten documents or sales agreements contrary to regulations on land law.
The above acts cause complicated difficulties for land management, affecting the legitimate rights of households and the state management order of land in the special zone area.
In addition, the situation of some households arbitrarily using land for the wrong purpose is recorded on the certificate of land use rights, house ownership rights and other assets attached to the land ( Certificate). Specifically: Construction of housing works; construction of concrete paths on agricultural land, land not yet allowed to change land use purpose, and at the same time carry out procedures to separate into many plots of land to transfer land use rights. This is contrary to the principles of land use stipulated in the Land Law and leads to the risk of forming spontaneous subdivision areas, disrupting construction planning, urban areas, causing difficulties in land management and urban order in the locality.
To ensure state management of land, construction, urban order and progress of granting Land Use Rights Certificates, the People's Committee of the Special Zone requests that all land users in the special zone and relevant agencies and units coordinate in implementing the contents. For land users, they must use land within the correct boundaries and purposes stated on the certificate, and absolutely must not encroach or occupy land managed by State organizations.
Contact the competent authority to carry out procedures for converting land use purposes from agricultural land to residential land or non-agricultural land permitted for construction when needed and meeting the prescribed conditions. Declare honestly, accurately, in accordance with actual land use and related records and documents when implementing land registration declaration and issuance of Land Use Rights Certificates. Not listening, not conducting transactions, buying and selling, transferring land of unknown origin or land without a certificate; land with signs of encroachment, occupation, avoiding causing damage to property and personal rights.
Forces of using land for purposes other than those specified, boundaries, encroachment, or occupation of land managed by State organizations; dishonest declaration, and illegal use of documents will be handled according to the provisions of law.
In case of serious violations of intentional dishonest declaration of land registration, land occupation, and use of unlicensed fake documents, criminal proceedings may be considered for handling according to the provisions of law.
The An Giang Provincial Land Registration Office - Phu Quoc Special Zone Branch does not receive or handle land division records for cases where land users are using land for purposes other than those stated on the certificate (building housing works, building concrete walkways on agricultural land, land not allowed to change land use purposes) until the land user has remedied the violation and used the land for the purpose granted the certificate.
