Recently, the People's Committee of Kien Giang province issued a Decision specifying the conditions and minimum area for land division and land consolidation for each type of land in the province. This Decision takes effect from October 20, 2024.
Accordingly, the type of land that is divided or merged is determined according to the land use purpose recorded on the land use right certificate; Certificate of house ownership and land use right; Certificate of land use right, house ownership and other assets attached to land; Certificate of land use right, ownership of assets attached to land (hereinafter referred to as the certificate).
The division of land plots in real estate projects within the scope of regulation of the law on real estate business shall be carried out in accordance with the law on real estate business.
The minimum area after subdivision for urban land is 36m2, for rural land is 45m2. At the same time, the width of the frontage of the land plot and the length of the adjacent sides of the frontage of the land plot must not be less than 4m.
For non-agricultural land that is not residential land without detailed planning 1/500: Commercial and service land is 200m2. In case of changing the purpose of use from residential land to commercial and service land that requires land division, the minimum area is 100m2. Non-agricultural production land and other types of non-agricultural land: 500m2.
At the same time, the People's Committee of Kien Giang province also stipulates that the minimum area after land division for agricultural land is as follows: For land for annual crops in urban areas including Rach Gia City, Ha Tien, Phu Quoc is 600m2, in other districts is 1,000m2; in rural areas of the three cities is 1,000m2, in other districts is 2,000m2.
Land for perennial crops and other agricultural land in urban areas including 3 cities is 300m2, in districts is 500m2; rural areas in 3 cities is 500m2, in other districts is 1,000m2.
Aquaculture land in urban areas is 1,000m2, rural areas is 2,000m2. Concentrated livestock land and production forest land is 3,000m2.
In addition, the People's Committee of Kien Giang province also stated regulations on land division for some other specific cases, regulations on land consolidation and transition.
