HCMC - Truong My Lan and other defendants appeared in court for the appeal trial (phase 1) at the HCMC High People's Court on the morning of November 4.
On the morning of November 4, the High-Level People's Court in Ho Chi Minh City considered the appeal of Truong My Lan and 47 defendants regarding violations related to Saigon Commercial Joint Stock Bank (SCB) and Van Thinh Phat Group (phase 1 of the case).In addition to appealing the death sentence for embezzlement causing losses of 677,000 billion VND of SCB, Truong My Lan also asked the appellate court to waive 673 billion VND in court fees.In this appeal, Do Thi Nhan (former Director of the State Bank Inspection and Supervision Department) appealed for a reduction of her life sentence for accepting bribes. Nguyen Cao Tri (former Chairman of Capella Group) asked for a reduction of his 8-year sentence for abusing trust to appropriate 1,000 billion VND of Truong My Lan's assets. Before the appeal, Nguyen Cao Tri had paid the full amount of 1,000 billion VND to repay the defendant Lan and had filed a request for a trial in absentia due to being treated for a spinal injury.The panel of judges summoned Truong My Lan and her husband Chu Lap Co, niece Truong Hue Van and several other defendants to the trial.Some remaining defendants are still at T30 detention camp of the Ministry of Public Security, Cu Chi, participating in the trial via television.The appeal hearing took place from November 4 to November 25. In front of the court gate, mobile forces and police were present to maintain security and order.At the first instance trial on April 11, the Ho Chi Minh City People's Court sentenced defendant Truong My Lan and 85 defendants in the Van Thinh Phat case, phase 1. The Ho Chi Minh City People's Court's Trial Panel sentenced defendant Truong My Lan to death for embezzlement, 20 years in prison for bribery, and 20 years in prison for violating lending regulations in the operations of credit institutions. Total death penalty for defendant Truong My Lan.In the Van Thinh Phat trial (phase 1), Truong Khanh Hoang, former acting General Director of SCB, was sentenced to 18 years in prison. At this appeal hearing, defendant Truong Khanh Hoang appealed for a reduced sentence.
According to the indictment, defendant Truong My Lan owns 91.5% of SCB's shares and is a shareholder with the "power" to manipulate all of SCB's operations to serve her own purposes.
To take money from SCB, defendant Lan and his accomplices carried out a series of actions: Selecting and arranging personnel for key positions at SCB; establishing a number of units under SCB specializing in lending and disbursing on demand; establishing and using thousands of "ghost companies"...
Along with that, colluding with many valuation companies to inflate the value of collateral; creating fake loan documents to withdraw money from SCB; making plans to withdraw money, "cut off" cash flow after disbursement; selling bad debts, selling deferred credit loans to reduce credit balance, reduce bad debts, to conceal violations; bribing and influencing people with positions and powers in state agencies to violate public duties.
From 2012 to 2022, Truong My Lan directed the creation of fake documents, loans, and disbursements for 2,527 loans (including 1,057 loans to individual customers and 1,470 loans to institutional customers) with a total amount of more than 1 million billion VND.
As of October 17, 2022 (the time of prosecution), there were 1,284 loans (including 440 individuals borrowing 512 loans, 435 organizations borrowing 772 loans) with an outstanding debt of more than VND 677,000 billion that could not be recovered.
