How long must the decision to enforce land dispute settlement be implemented

According to regulations, the enforcement of land dispute resolution decisions must be carried out within a certain period of time.

Pursuant to the provisions of Clause 3, Article 108 of Decree 102/2024/ND-CP, amended by Point d, Clause 5, Article 5 of Decree 151/2025/ND-CP as follows:

Article 108. Bases for resolving land disputes in cases where the disputing parties do not have documents on land use rights, enforcement of land dispute resolution decisions

3. Issuing a decision to enforce the implementation of the decision to resolve land disputes

a) Within 15 days from the date of receipt of the request to implement the decision to resolve the land dispute, the Chairman of the People's Committee of the commune where the land is in dispute shall issue a decision to enforce the implementation of the decision to resolve the land dispute;

b) The enforcement decision must be implemented within 10 days from the date the person subject to enforcement receives the enforcement decision or from the date the People's Committee at the commune level makes a record of the absence of the person subject to enforcement or the person subject to enforcement refuses to receive the enforcement decision, except in cases where the enforcement decision stipulates a longer period of time.

Accordingly, the decision to enforce the settlement of land disputes must be implemented within the following period, specifically:

- Within 15 days from the date of receipt of the application for implementation of the decision to resolve land disputes, the Chairman of the People's Committee of the commune where the land is in dispute shall issue a decision to enforce the implementation of the decision to resolve land disputes.

- The enforcement decision must be implemented within 10 days from the date of:

+ The person subject to enforcement receives the enforcement decision.

+ The People's Committee at the commune level shall make a record of the absence of the person subject to enforcement.

+ The person subject to enforcement refuses to accept the enforcement decision.

Except in cases where the decision to enforce the regulation takes a longer time.
