Slow implementation of inspection conclusions
Hundreds of residents in buildings 18T1 and 18T2 of The Golden An Khanh apartment complex (Hoai Duc, Hanoi) are waiting wearily to receive their Certificate of land use rights, house ownership rights and other assets attached to the land (pink books).
According to documents obtained by Lao Dong, the reason for the delay in granting pink books to people is that the relevant parties have not fully implemented the inspection conclusions of the Hanoi City Inspectorate.
It has been 7 years since the Inspection Conclusion No. 4052 in 2017 and during this time, Hanoi has repeatedly issued documents urging and reminding the implementation of the inspection conclusion.
On December 23, 2021, the Hanoi City Inspectorate issued a document reporting to the Hanoi City People's Committee on the implementation after the inspection and examination of The Golden An Khanh project.
In this document, the Hanoi Inspectorate said that out of 7 departments, branches, agencies and units that must implement inspection and examination conclusions, only 4 units have done so, while 3 units have not: Department of Natural Resources and Environment (TNMT); Department of Planning and Architecture and Department of Construction.
Therefore, the Hanoi City Inspectorate continues to recommend that the Hanoi City People's Committee direct and request units to seriously learn from the slow implementation of the conclusions and recommendations of the City Inspectorate. At the same time, promptly implement the direction of the Hanoi City People's Committee in previous documents on handling after inspection and examination.
Review and determine financial obligations
Regarding the request for granting pink books of many residents of The Golden An Khanh, the Hanoi Land Registration Office issued document 10613 dated August 21, 2024 to residents and Song Da Hoang Long Company in response to the request for granting pink books to residents of buildings 18T1, 18T2, The Golden An Khanh apartment building.
Hanoi Land Registration Office said that this unit has requested Song Da Hoang Long Company to contact the Department of Natural Resources and Environment to conduct an inspection and review to determine additional financial obligations according to the provisions of law (if any) according to the direction of the Hanoi People's Committee and the conclusion of the Hanoi Inspectorate on the project.
"However, up to now, Song Da Hoang Long Company has not reported on the correction of the above contents, so the Hanoi Land Registration Office has no basis to report and issue Certificates to home buyers at the above project" - the document of the Hanoi Land Registration Office stated.
After receiving a document from the Hanoi Land Registration Office, on September 9, 2024, Song Da Hoang Long Company sent a document to the Hanoi Department of Natural Resources and Environment requesting that the company pay in advance more than VND 6,688 billion in land use fees for the area of land lot HH6.
On October 1, 2024, Hanoi Land Registration Office continued to send a document to Song Da Hoang Long Company.
Accordingly, the Hanoi Land Registration Office received many requests to continue issuing pink books to buyers of houses and commercial service floors at buildings 18T1 and 18T2.
The unit also received a document from Song Da Hoang Long Company regarding the continued issuance of pink books. However, this content does not have sufficient basis for determination and is not under the jurisdiction of the Hanoi Land Registration Office.
In order to have a basis for considering the issuance of the pink book that has fulfilled its obligations to the investor, Song Da Hoang Long Company is requested to contact the Hanoi Department of Natural Resources and Environment to conduct an inspection and review to determine the additional financial obligation to pay land use fees according to the provisions of law (if any).
After the results are approved by the competent authority and the investor fully fulfills its financial obligations to the State budget (if any), the Hanoi Land Registration Office will report to the Hanoi Department of Natural Resources and Environment to immediately issue pink books to home buyers at the project according to regulations.
