According to the decision to announce internal administrative procedures, amend and supplement the land sector that the Ministry of Agriculture and Environment has just issued, there are many new regulations on the order and procedures for building the first land price list to be announced and applied from January 1, 2026.
Accordingly, the land price list will be adjusted, amended and supplemented annually to be announced and applied from January 1 of the following year to the provincial level. The agency deciding on the land price list will transfer from the Provincial People's Committee to the Provincial People's Council.
In addition, there are 3 new procedures related to land carried out at the commune level, including: Land recovery for households, individuals, and communities subject to land law violations as prescribed in Article 81, Land Law; Land recovery due to termination of land use according to law, voluntary return of land, risk of threatening human life, no longer being able to continue using according to Clauses 1, 2 and 3, Article 82, Land Law; Land recovery for cases specified in Clause 1, Article 48 of the Land Law.
The provincial level implements a new procedure of land recovery for domestic organizations, religious organizations, affiliated religious organizations, people of Vietnamese origin residing abroad, foreign organizations with diplomatic functions, and economic organizations with foreign investment capital that are subject to land law violations.
The Decision also amends and supplements 3 procedures under the scope of the Ministry's tasks, including: 2 provincial-level procedures for the first land price list to be announced and applied from January 1, 2026 and adjusting, amending and supplementing the annual land price list to be announced and applied from January 1 of the following year and specific land valuation procedures for cases under the authority of the Chairman of the Provincial People's Committee; 1 commune-level procedure is a specific land valuation procedure for cases under the authority of the Chairman of the Commune People's Committee.
The decision takes effect from September 25, 2025.
