Responding to this content, the Ministry of Agriculture and Environment responded as follows:
Regarding the extension of land use term, Clause 3, Article 172 of the 2024 Land Law (effective from August 1, 2024) stipulates:
The extension of land use shall be carried out in the last year of the land use term, except for the case specified in Point a, Clause 1 of this Article.
Land users who need to extend land use must submit an application for extension no later than 6 months before the expiration of the land use term.
If the land user fails to submit the extension request within the deadline, the land use term will not be extended, except in cases of force majeure.
In case the land use term is not extended, the competent State agency shall recover the land in accordance with the provisions of this Law.
The Ministry of Agriculture and Environment also noted that readers should study and implement it in accordance with the above regulations, the extension of land use is carried out in the last year of the land use term.
According to Lao Dong, according to Article 171 of the 2024 Land Law, the following types of land are land for long-term stable use:
Residential land.
Agricultural land used by the community as prescribed in Clause 4, Article 178 of this Law.
Special-use forest land; protective forest land; production forest land managed by organizations.
Commercial, service land, non-agricultural production land of individuals in stable use recognized by the State, not land allocated by the State for a term or leased.
Land for building agency headquarters, land for building public service works.
National defense and security land.
Land of belief.
Religious land.
Land used for public purposes without business purposes.
Land for cemeteries, funeral homes, crematoriums; land for facilities for storing ashes.
