Answering voters' recommendations related to construction permit procedures, the Ministry of Construction said that the amended Construction Law will take effect in the near future with many adjustments in the direction of reducing administrative procedures.
One of the notable contents is the expansion of cases where individual houses are exempt from construction permits, thereby creating favorable conditions for people when deploying construction.
According to new regulations, individual houses with a scale of less than 7 floors and a total floor area of less than 500m2 in certain areas will not have to apply for a construction permit.

In particular, works located in urban projects or residential areas that have detailed planning approved by competent authorities are also eligible for exemption. In rural areas, if architectural management regulations have not been issued, people building individual houses do not have to carry out procedures to apply for permits as before.
However, the Ministry of Construction emphasized that not all cases are exempted. For areas that already have architectural management regulations or are subject to strict management of planning and construction order, people must still complete the procedures for applying for permits according to regulations. Projects with larger scale or not subject to exemption must still comply with the current appraisal and permit process.
The management agency said that in parallel with adjusting the cases of exemption, the procedures for issuing construction permits for compulsory cases will also be reformed in the direction of shortening the processing time of dossiers, promoting online implementation and reducing intermediaries. The goal is to ensure effective state management but not cause trouble or cost for people.
Clarifying the regulations related to construction permit exemption is expected to contribute to unifying the understanding and implementation in the locality, and at the same time create more favorable conditions for individual housing construction activities in the coming time.
