Pursuant to Clause 1, Article 82 of the 2023 Housing Law amended by Point h, Clause 5, Article 57 of the 2024 Law on Urban and Rural Planning, the types of houses and standards for social housing areas are as follows:
Article 82. Types of houses and standards for social housing area
1. Types of houses and standards for social housing areas are regulated as follows:
a) Social housing is an apartment building, invested in and built according to a project, in accordance with the detailed planning according to the law on urban and rural planning that has been approved. In case the social housing construction investment project is invested in construction in a commune in an ethnic minority and mountainous area according to the provisions of the Prime Minister, individual houses may be built;
b) In case social housing is an apartment building, the apartment must be designed and built according to national technical standards on apartment buildings and social housing area standards;
c) In case social housing is an individual housing, it must be designed and built in accordance with the provisions of the law on construction and social housing area standards;
d) In case an individual builds a social housing unit as prescribed in Clause 6, Article 80 of this Law, he/she may build a multi-storey house with many apartments or a separate house as prescribed in this Law.
2. The Government shall detail this Article.
Accordingly, the type of house and the standard area of social housing are regulated as follows:
- Social housing is an apartment building, invested in and built according to a project, in accordance with the detailed planning according to the approved law on urban and rural planning.
In case the social housing construction investment project is invested in construction in a commune in an ethnic minority and mountainous area according to the provisions of the Prime Minister, individual houses may be built;
- In case social housing is an apartment building, the apartment must be designed and built according to national technical standards on apartment buildings and social housing area standards;
- In case social housing is an individual house, it must be designed and built according to the provisions of the law on construction and social housing area standards;
- In case individuals build social housing according to the provisions of Clause 6, Article 80 of the 2023 Housing Law, they can build multi-storey houses with many apartments or individual houses according to the provisions of the 2023 Housing Law.
