Procedures for registering land, assets attached to land, and granting Certificates of land use rights and ownership of assets attached to land for the first time to households, individuals, communities, and people of Vietnamese origin residing abroad according to Decision 3380/QD-BNNMT dated August 25, 2025 of the Ministry of Agriculture and Environment.
Step 1: The candidate submits the application to the Public Administration Service Center.
When submitting the prescribed documents, the registration fee is selected to submit a copy of the document and present the original for the officer receiving the application to check the comparison or submit the original of the document or submit a notarized or certified copy of the document according to the provisions of the law on notarization and certification; in case of submitting the application online, the submitted dossier must be digitized from the original or the certified and certified copy of the document according to the provisions of law.
In case of submitting a copy or digital copy of all documents, when receiving the results of handling administrative procedures, the registered candidate must submit the original documents in the dossier components according to regulations.
Step 2: The dossier receiving agency implements:
- Check the completeness of the dossier components and issue a dossier receipt and schedule a return of results. In case the documents are not complete, the documents must be returned with the Supplement and Complete Application Form so that the applicant can register to complete and supplement according to regulations.
- Transfer the dossier to the People's Committee of the commune where the land is located.
Step 3:
3.1. In case of carrying out registration and issuance procedures for Certificates, the People's Committee at the commune level shall organize the implementation of the following contents:
a) General maps for places where maps have been provided. For places that do not have a cadastral map and the cadastral map measurement piece is in the registration and issuance dossier and the Certificate has a cadastral map measurement piece, the inspection and signing of the certificate shall confirm the cadastral map measurement piece according to regulations, except in cases where the cadastral map measurement piece has been confirmed by the People's Committee at the commune level or the Branch of the Land Registration Office shall inspect and sign before July 1, 2025; in case the registration and issuance dossier and the Certificate do not have a cadastral map measurement piece, the surveying unit shall be required to carry out the cadastral map measurement within no more than 05 working days from the date of receipt of the request.
b) Confirm the current status of land use with or without houses or construction works; the status of land disputes, assets attached to land, stable land use; in case there are no documents on land use rights, the origin of land use will be further confirmed.
c) Check compliance with the planning in cases where compliance with the planning is required to issue a Certificate.
d) Publicly post the results of inspections and reviews according to Form No. 17 issued with Decree No. 151/2025/ND-CP at the headquarters of the People's Committee at the commune level, residential areas where there is land and assets attached to the land within 15 days, and at the same time consider and resolve opinions reflecting on the content that has been made public (if any).
d) Check whether or not eligible for a Certificate of Land Use Rights and Property Ownership Rights attached to land according to the provisions of the law on land:
- In cases where there is no need or is no requirement to issue a Certificate, the following shall be done:
+ Issued a Notice confirming the results of land registration according to Form No. 16 issued with Decree No. 151/2025/ND-CP; transfer the Notice to the place of application to return to the registration requestor.
+ Transfer the dossier to the Branch of the Land Registration Office to establish and update information on land registration and assets attached to land in the cadastral records and land database.
- In case of need and eligibility for a Certificate, send the Information Transfer Form to determine financial obligations for land according to Form No. 19 issued with Decree No. 151/2025/ND-CP amended and supplemented in Decree No. 226/2025/ND-CP to the tax authority so that the tax authority can determine and notify the collection of financial obligations for land users and owners of assets attached to land.
e) When there is information from the database that is connected or documents or papers proving that financial obligations have been fulfilled or financial obligations have been debtors:
- Chairman of the People's Committee at the commune level issued a Certificate of land use rights and ownership of assets attached to land.
- Transfer the Certificate to the dossier receiving agency to give to the land user or owner of the property attached to the land.
- Transfer the dossier with a copy of the issued Certificate to the Branch of the Land Registration Office to establish, update, and edit cadastral records and land database.
3.2. In case there is a Notice confirming the results of land registration, the People's Committee of the commune where the land is located shall:
- In case the Notice of Confirmation of the results of land registration and assets attached to land shows that it is eligible for a Certificate and at the time of issuance of the Certificate is not subject to the provisions of Point d and e, Clause 1, Article 151 of the Land Law, the Information Transfer Form to determine financial obligations for land shall be sent according to Form No. 19 issued with Decree No. 151/2025/ND-CP amended and supplemented in Decree No. 226/2025/ND-CP to the tax authority so that the tax authority can determine and notify the collection of financial obligations for land users and owners of assets attached to land.
- In case the Notice of confirmation of land registration results does not show eligibility for a Certificate, the work will be carried out at points b, c, d, and d, section 3.1.
- When there is information from the database that is connected or documents or papers proving that financial obligations have been fulfilled or financial obligations have been deb debtors:
+ Chairman of the People's Committee at the commune level issues a Certificate of land use rights and ownership of assets attached to land.
+ Transfer the Certificate to the dossier receiving agency to give to the land user, owner of the property attached to the land.
+ Transfer the dossier with a copy of the issued Certificate to the Branch of the Land Registration Office to establish, update, and edit cadastral records and land database.
