Pursuant to Point a, Clause 2, Article 89 of the 2023 Housing Law, it is stipulated as follows:
Article 89. Selling, leasing, buying, leasing social housing
2. The lease-purchase of social housing is carried out in accordance with the provisions of Point a and Point b, Clause 1 of this Article and the following provisions:
a) The minimum period for payment of social housing rental is 5 years, from the date of signing the housing purchase rental contract;
b) The lessee who buys social housing is not allowed to resell the house for a period of 5 years from the date of full payment of the house purchase rent within the period prescribed in Point a of this Clause, except for the case specified in Point c of this Clause;
c) Within 5 years from the date the lessee has paid the full rental price for the house and has a need to sell the house, he/she may only resell it to the house management agency in the case of renting a social housing invested in construction with public investment capital or reselling it to the investor of a social housing construction investment project in the case of renting a social housing invested in construction without public investment capital or reselling it to a subject eligible to buy a social housing with the maximum selling price equal to the selling price of this social housing in the sale and purchase contract with the house management agency or the investor of a social housing construction investment project. Personal income tax payment is implemented in accordance with the provisions of the law on tax;
d) After a period of 5 years, from the date the lessee has paid the full rental fee for social housing within the time limit prescribed in Point a of this Clause, the lessee may resell this house according to the market mechanism prescribed in Point e, Clause 1 of this Article.
Thus, the period of payment for social housing rental is calculated from the date of signing the housing purchase rental contract. And the minimum payment period is 5 years according to regulations.
