A resident with permanent residence in Hanoi, working as a freelancer, and also having agricultural land and directly producing in Thai Nguyen province. Currently, this land area is subject to state recovery.
According to reports, to be considered for support in training, vocational conversion and job search, the land clearance agency guides people to apply for confirmation at the commune-level People's Committee where they reside about not having regular income and not receiving salaries from the State budget.
In addition, people are required to contact the Ward People's Committee where there is agricultural land to apply for confirmation that they are individuals directly engaged in agricultural production and have a stable income from agricultural production activities.
People have been confirmed by the residential authorities according to instructions. However, when carrying out procedures in the locality where the land is located, the Ward People's Committee only confirms that this person has agricultural land in the area, not confirming the content of income from agricultural production.
From the above case, people request competent authorities to clarify whether the request for confirmation papers as above is in accordance with regulations or not, and at the same time guide procedures to receive support when the State recovers land.
Answering the reflection, the Department of Land Administration, Ministry of Agriculture and Environment said that the order and procedures for compensation, support, resettlement and land recovery have been amended and supplemented in Article 15 of Decree No. 49/2026/ND-CP dated January 31, 2026 of the Government.
According to regulations, the Provincial People's Committee is responsible for issuing administrative procedures for compensation, support, resettlement and land recovery for cases specified in Article 14 of Decree No. 49/2026/ND-CP. The deadline for issuance is July 1, 2026.
While the locality has not issued new regulations, the Provincial People's Committee decides to apply the order and procedures for compensation, support, resettlement and land recovery according to the provisions of law before Decree No. 49/2026/ND-CP takes effect.
The provincial-level People's Committee can also decide on the order and administrative procedures for land for each specific case.
The Department of Land Administration believes that the content reflected belongs to a specific case in the locality. Therefore, people need to contact the land management agency in Thai Nguyen province or the agency implementing compensation and site clearance to be checked for dossiers and guided according to regulations issued by the provincial People's Committee or decisions applied.
