Ho Chi Minh City clears 1,270 households in Binh Thanh and Go Vap districts

HCMC - The Xuyen Tam Canal renovation project will affect 2,215 households and organizations in Binh Thanh and Go Vap districts, of which 1,270 households will be completely cleared.

The Department of Natural Resources and Environment of Ho Chi Minh City has just submitted a document to the People's Committee of Ho Chi Minh City on measures and other support levels to ensure housing, stabilize life and production for people whose land is recovered, and owners of assets attached to land in the Xuyen Tam canal renovation project.

The project passes through Binh Thanh and Go Vap districts with a total of 2,215 households and organizations affected.

In Go Vap district, there are 138 cases of land reclamation, including 137 households and Van Lang University. Of these, 40 households will be completely cleared and 98 households will be partially cleared.

In Binh Thanh district, the project will reclaim land in 2,077 cases. Of these, 1,230 households and 23 organizations will be completely cleared, while the remaining 824 cases will be partially cleared.

The Ho Chi Minh City Department of Natural Resources and Environment has proposed support for households that do not meet the compensation requirements as prescribed. The level of support will be determined based on the origin and time of land use, as well as the reason for ineligibility.

For cases where the recovered land area does not violate the law, is not recognized for land use rights and is in stable land use, support will be divided into two groups.

Land use before October 15, 1993: 100% land value support but not exceeding 160 m², the excess area will be calculated according to agricultural land price.

Land use from October 15, 1993 to before July 1, 2014: 100% land value support but financial obligations must be deducted, supported area must not exceed 160 m².

In cases of land use that violated land laws before July 1, 2014, but has been used stably and is not eligible for a land use right certificate, the support level is divided into 2 types.

Use for non-agricultural purposes (including residential land and non-residential non-agricultural land): Use before October 15, 1993 is supported with 70% of land price; use from October 15, 1993 to before July 1, 2004 is supported with 56% of land price; use from July 1, 2004 to before July 1, 2014 is supported with 42% of land price. Supported area does not exceed 160 m². Excess area will be calculated according to agricultural land type.

Use for agricultural purposes will be supported 70% of agricultural land price according to compensation price.

For land originating from rivers, streams, canals, ditches, streams and specialized water surfaces that have been encroached upon, occupied and self-converted for land use purposes, there will be no compensation but support for land (including the leveled area and the unleveled area but with houses, constructions and architectural structures).

In cases where land compensation conditions are not met and land use dates are from July 1, 2014 onwards, land support will not be provided.

In case the land has been granted a certificate of land use purpose as agricultural land, the household has changed the land use purpose, built a house before July 1, 2014, has a separate area, has a clear permanent and temporary residence record, is stable in use, and has no disputes, then the support will be considered at 100% of the residential land price and must deduct financial obligations. The supported area is the actual recovered residential land area in use but does not exceed 160 m².

The Xuyen Tam Canal renovation project had an initial total investment of over VND9,600 billion, but has just been adjusted to increase to over VND17,229 billion. Of which, compensation costs accounted for VND13,937 billion, the rest was construction costs and other costs.

According to plan, the section through Go Vap district will start construction in November 2024 and the section through Binh Thanh district will start construction before April 30, 2025.
