Pursuant to Article 38 of Decree 100/2024/ND-CP, the order and procedures for selling social housing invested in and built according to the project and not using public investment capital or trade union financial resources are as follows:
Step 1. Submitting documents
- Households and individuals who need to submit documents to buy social housing directly to the project investor. The dossier includes:
+ Application for social housing purchase according to Form No. 01 prescribed in Appendix II issued with Decree 100/2024/ND-CP.
+ Documents proving the subjects and conditions for enjoying social housing support policies.
Step 2. Receiving and checking records
- After gathering all registration papers, the investor is responsible for reviewing each dossier, conducting comparison with the regulations on subjects, conditions and forms of papers under the guidance of the Minister of Construction, the Minister of Defense and the Minister of Public Security to make a list of social housing buyers under the project as an investor.
- In case the person wishing to register for a social housing has submitted a valid dossier to the investor but there is no house fund to resolve: The project owner is responsible for clearly stating the reason and sending it back (including documents proving the object and conditions to buy social houses that the registered person has submitted) so that the person knows and submits the dossier at other projects.
- When the person in need of submitting the application is required to record the receipt. If the application is invalid (not in accordance with regulations), the dossier recipient is responsible for clearly stating the reason for not being resolved and returning it to the dossier submitter for supplementation and completion.
- In the process of receiving the application for registration of social housing, the investor of the social housing construction project is responsible for publicly listing the list of apartments sold (signed contracts), the remaining list of apartments at the place of receiving the registration dossier to buy social houses, the working office of the investor and the real estate trading floor of the investor (if any) so that the people need to buy and buy houses in the project.
Step 3. Submit the list of social housing purchases to the Department of Construction
- The investor shall submit a list of subjects expected to buy social housing in order of priority according to the principle prescribed in Clause 2, Article 38 of Decree 100/2024/ND-CP to the Department of Construction at the location of the project to eliminate cases that are not eligible for purchase.
Accordingly:
+ The Department of Construction will send a notice to the investor to remove the names of unqualified people from the List of social housing buyers.
+ If after 20 days from receipt of the List, the Department of Construction does not respond, the investor will notify the subjects eligible to buy social housing to reach an agreement, agree and sign the contract.
- In case the person in need, even though he/she is eligible and is included in the list of eligible to buy social housing, no longer needs to buy it, the investor will return the application to the person who submitted the application.
Step 4. Signing a contract
- The buyer pays directly to the investor or through a bank agreed upon by the investor and the buyer.
- Investors are only allowed to sign a sales contract when they are eligible for sale and the selling price has been approved according to regulations.
Step 5. Announcing the list of people eligible to buy a house
- After signing a sales contract, the investor will make a list of subjects (including members of the household) who have purchased social housing and send it to the Department of Construction within 30 days. The Department of Construction updates the List of people eligible to buy social housing on the Department of Construction's Electronic Information page.
- The Department of Construction shall send a list of people eligible to buy social housing to the Ministry of Construction.
- The investor publicly announces the list of subjects eligible to buy social housing at the head office and real estate trading floor or the investor's Social Housing Information page (if any).
