On the Government Portal, citizen H.D.M in Phu Tho reported that he bought a plot of land from an individual. The land plot was liquidated by a road management and repair company, with invoices for land purchase and sale for liquidation and a record of handover of real estate assets.
Currently, Mr. M wants to apply for a red book, but the commune land authority said that his land has not been transferred by the company, so he cannot do it.
Mr. M asked if he wanted to apply for a red book and what documents did he need?
Regarding this issue, the Ministry of Agriculture and Environment responded as follows:
The application of policies to review and issue certificates to households and individuals using land needs to be based on each specific case and needs to be based on local land management records. The Ministry of Agriculture and Environment has the following principles:
The current land law has provisions on the issuance of certificates of land use rights and ownership of other assets attached to land for the first time to individuals and households currently using land in Articles 137, 138, 139, 140 and 141 of the 2024 Land Law.
The order and procedures for first-time registration of land and assets attached to land for individuals, communities, and households currently using land and the order and procedures for granting a Certificate of land use rights and ownership of assets attached to land are stipulated in Section II and Section V, Part C, Appendix I issued with Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government regulating the determination of the authority of local authorities at 02 levels, decentralization and delegation in the field of land.
The issuance of initial certificates to households and individuals is under the authority of the Chairman of the People's Committee at the commune level (according to the provisions of Point b, Clause 1, Article 5 of Decree No. 151/2025/ND-CP).
The Ministry of Agriculture and Environment informs citizens to know, research, and contact competent authorities in the locality for settlement according to regulations.
