Many preferential policies for teachers in the draft Law on Teachers
The draft Law on Teachers is being considered and expected to be approved at the 9th Session of the 15th National Assembly.
The draft Law on Teachers stipulates that teachers' salaries will be ranked highest in the administrative career salary scale system, and there will be additional allowances depending on the nature of the work and the working area.
In addition to salary policy, Article 26 of the Draft Law on Teachers also clearly stipulates policies to support teachers, including: Subsidy regime according to job nature, by region; Training and fostering support; Support for periodic health care, occupational health care; Mobile allowances for teachers working in illiteracy eradication, universal education, secondment, enhanced teaching, inter-school teaching, teaching at schools; Other support policies for teachers, etc.
Notably, the Draft Law stipulates that teachers in preschool education institutions, if they wish, can retire at a lower age than the retirement age of employees under normal conditions but not more than 5 years old. In case of having paid social insurance for 15 years or more, the pension percentage due to early retirement will not be reduced.
Expected increase in preferential allowances for preschool teachers and school staff
The Ministry of Education and Training (MOET) is seeking opinions on the Draft Decree regulating preferential allowances according to occupation for civil servants and employees working in public educational institutions.
According to the draft, preferential allowances for preschool teachers are expected to increase from 35% to 45 in favorable areas, while in areas with difficult socio-economic conditions, it is 80%.
In addition, in the draft, school staff depending on their working position are expected to receive preferential allowances from 15 to 25% depending on their job position, for the first time there is a draft of school staff entitled to preferential allowances to recognize their efforts and help them have more income to stick with the profession, contributing to supporting and helping the industry and educational institutions to successfully complete their tasks.
Expected new regulations on paying extra teaching salaries to benefit teachers
The Ministry of Education and Training has published a Draft Circular regulating the regime for paying overtime wages to teachers, replacing Joint Circular No. 07/2013/TTLT-BGDDT-BNV-BTC and amending and supplementing Clause 2, Article 3 of Circular No. 05/2025/TT-BGDDT.

The draft proposes to remove regulations on conditions for payment of overtime teaching benefits for teachers, instead, only stipulate the total maximum number of teaching hours in a school year for which each educational institution is allowed to pay overtime.
At the same time, it is added a regulation that the total number of extra teaching hours in a school year of all teachers must not be higher than the total maximum over teaching hours in a school year of the educational institution.

The draft also stipulates that for preschool teachers, the maximum number of extra teaching hours in a school year for each teacher to be paid for extra teaching wages must not exceed the number of extra working hours according to the provisions of the law on labor. As for other teachers, there are no more than 150 teaching hours/school year.
The draft also mentioned that, in case the subject cannot arrange enough teaching people, teachers must teach in excess of the maximum number of hours paid, the head of the educational institution reports to the competent management agency to pay for additional tutoring wages for that teacher.
The draft Circular stipulates that teachers who retire, are on sick leave, have maternity leave exceeding the provisions of law, are on unpaid leave or are on other unpaid leave cases that do not directly participate in teaching are entitled to receive overtime salary for actual working time.
