Mr. Le Luan is a junior high school teacher, recruited in November 2010. In November 2011, he was officially appointed to the rank of Junior High School Teacher 15a202, with a college degree. In 2017, Mr. Luan was ranked as a grade III professional. In 2020, Mr. Luan obtained a university degree and on April 1, 2021, he was transferred to the new grade III.
Mr. Luan asked: "Am I qualified to take the promotion exam?".
The Ministry of Education and Training responded to this issue on the Government Electronic Information Portal as follows:
The standards and conditions for registration for consideration of promotion of professional titles are specified in Article 32 of Decree No. 115/2020/ND-CP (amended in Clause 16, Article 1 of Decree No. 85/2023/ND-CP).
Including the condition that the minimum working time requirement for holding the next lower professional title must be met according to the requirements of the professional title standards for promotion consideration.
Point k Clause 4 Article 4 Circular No. 03/2021/TT-BGDDT has been amended and supplemented at Clause 4 Article 3 Circular No. 08/2021/TT-BGDDT stipulating: "Officials taking the exam or considering promotion to the professional title of Junior High School Teacher Grade II (code V.07.04.31) must have held the professional title of Junior High School Teacher Grade III (code V.07.04.32) or equivalent for at least 09 (nine) years (excluding probationary period) by the deadline for submitting application for the exam or consideration for promotion".
The determination of the time to hold the equivalent rank for the case of Grade III Secondary School Teachers registering for the exam or being considered for promotion to the professional title of Grade II Secondary School Teachers has been guided by the Ministry of Education and Training in Section 3.2 of Official Dispatch No. 4306/BGDDT-NGCBQLGD dated August 14, 2023.
Accordingly: From the time the teacher meets the training standards of the level of education, the time determined to be equivalent to the time holding the professional title of primary and secondary school teacher of the new grade III includes: Working time with compulsory social insurance; time holding teacher ranks equivalent to grade IV and grade III; time holding the professional title of Grade IV and Grade III Teacher and other time determined by the competent authority to be equivalent to grade IV and grade III when transferring professional titles (excluding probationary period).
The Ministry of Education and Training also requested Mr. Le Luan to study the above regulations to determine the level of meeting the standards and conditions for registering for the professional title promotion and prepare the necessary conditions to register for the professional title promotion from level III to level II when organized by the local competent authority.
