Reporting on labor changes is a mandatory obligation of employers, specifically regulated in Decree 145/2020/ND-CP and Decree 129/2025/ND-CP. The time frames, report receiving agencies and implementation processes have been clearly guided to ensure unified labor management nationwide.
According to Article 71 of Decree 129/2025/ND-CP (effective from July 1, 2025), employers must periodically report on the situation of labor changes according to Clause 2, Article 4 of Decree 145/2020/ND-CP. The report is conducted periodically every 6 months (before June 5 every year) and annually (before December 5). The report is sent to the Department of Home Affairs through the National Public Service Portal, according to Form No. 01/PLI, Appendix I issued with Decree 145/2020/ND-CP. At the same time, employers must notify the social insurance agency where the head office, branch or representative office is located.
In case the report cannot be sent through the public service portal, the enterprise must submit the report in paper form, also according to Form No. 01/PLI, to the Department of Home Affairs and the corresponding social insurance agency. For workers working in industrial parks and economic zones, in addition to the above units, enterprises must also report to the Management Board of Industrial Parks and Economic Zones to serve monitoring and management.
After receiving the report, the Department of Home Affairs is responsible for synthesizing the situation of labor changes, especially in cases where enterprises send paper reports. The synthesis must ensure complete and accurate updating of information according to Form No. 02/PLI, Appendix I, Decree 145/2020/ND-CP.
These regulations aim to ensure that labor data is managed consistently, promptly and serves the work of monitoring and policy making. proper implementation of the reporting process is not only a legal responsibility but also helps authorities grasp labor fluctuations, thereby protecting the rights of employees and enhancing discipline in human resource management at enterprises.
