Clause 3, Article 35 of the Law on Organization of Local Government 2025 stipulates as follows:
Resignation, dismissal, and removal of a person holding a position elected by the People's Council
1. People elected by the People's Council, if for health reasons or for other reasons that cannot continue to perform the task, they may resign. The resignation person must apply for resignation and send it to the agency or person competent to introduce the People's Council to elect that position. Agency or person competent to introduce the People's Council has elected that position to submit to the People's Council for dismissal of the person who applies for resignation at the nearest People's Council meeting.
2. The People's Council is dismissed and dismissed the Chairman of the People's Council, Vice Chairman of the People's Council, Head of the People's Council at the request of the Standing Committee of the People's Council.
3. The People's Council dismisses and dismissed the Chairman of the People's Committee of the same level at the request of the Chairman of the People's Council; dismissed and dismissed Vice Chairman and member of the People's Committee of the same level at the request of the President of the People's Committee.
4. Results of dismissal and dismissal of Chairman of the People's Council, Vice Chairman of the People's Council, Chairman of the People's Committee, Vice Chairman of the People's Committee must be approved by the competent agencies and persons in Clauses 3 and 4, Article 34 of this Law.
Accordingly, the Chairman of the People's Committee at the commune level is dismissed by the People's Council at the request of the Chairman of the People's Council.
