YouMe Law Company Limited said: Decree 154/2025/ND-CP stipulates the subjects, principles, policies for streamlining staff and responsibilities for implementing staff streamlining in agencies, organizations, and public non-business units of the Party, State, Vietnam Fatherland Front, and socio-political organizations from central to commune levels.
Based on Article 6 of Decree 154/2025/ND-CP stipulating 4 subjects entitled to early retirement, in addition to enjoying retirement benefits according to social insurance regulations, they also enjoy regimes according to the streamlining policy, specifically those who meet the conditions according to Decree 154/2025/ND-CP are not subject to pension rate deduction when retiring early.
Thus, if entitled to the early retirement policy according to Decree 154/2025/ND-CP, the pension rate according to regulations and other allowances (if any) will not be deducted.
It can be understood that the pension benefit rate of employees is calculated based on the number of years of social insurance contribution, not depending on the time of early retirement.
