Article 66 of Decree 115/2020/ND-CP, amended by Clause 37 of Decree 85/2023/ND-CP, stipulates the duties and powers of public service units as follows:
1. For public service units that self-insure a part of regular expenditures and public service units with regular expenditures guaranteed by the State:
a) Implement the State's regimes and policies for civil servants according to the decentralization;
b) Recruitment, signing, termination of work contracts, secondment, and consideration of promotion of civil servants according to decentralization and delegation;
c) Arrange, assign tasks and inspect the performance of tasks of civil servants; appoint, reappoint, dismiss, evaluate, train, and foster civil servants according to decentralization;
d) Carry out reward and discipline work for civil servants according to authority or propose to competent authorities to reward and discipline according to regulations;
d) Conduct the preparation of records and storage of personal records of civil servants under management according to regulations;
e) Resolve termination of employment or retirement for civil servants according to decentralization;
g) Signing case and case contracts for retired civil servants;
h) Statistics and reports to superior agencies and organizations on the quantity and quality of civil servant teams under their management according to regulations;
i) Resolve complaints and denunciations according to the provisions of law.
2. For public service units that self-insure regular expenditures and investment expenditures and public service units that self-insure regular expenditures, in addition to the tasks and powers specified in Clause 1 of this Article, there are also the following tasks and powers:
a) Decide on the list of job positions, the structure of civil servants according to professional titles and the number of employees according to the provisions of the Party and the law;
b) Organize recruitment of officials according to their competence; consider promoting the title of professional professional titles of A3 salary according to decentralization and authorization; Considering the promotion of professional titles, deciding to appoint, pay salary, raise salary level (regularly, before the deadline), seniority allowances over the framework for officials holding professional titles of class I ranked A2 and from class II or less under the scope of management.
c) Decision to send civil servants to attend seminars, conferences, research surveys and learn from experience abroad according to decentralization.
