Decree 173/2025 allows administrative agencies to sign contracts with experts in a number of fields when the staffing has not yet met the requirements.

From July 1, 2025, Decree 173/2025/ND-CP allows ministries, branches, localities, and Vietnamese representative agencies abroad to invite human resources outside the public sector to participate in performing professional tasks.

There are two approved forms: labor contracts and service contracts when the existing payroll or internal human resources do not ensure work progress.

The list of jobs allowed for rent has specific regulations.

With State agencies, it is possible to sign contracts to develop legal documents, research and propose mechanisms and policies; make plans and develop sectors and localities; design and implement digital transformation projects, artificial intelligence and information system security; integrate and synchronize national databases and exploit big data analysis to serve socio-economic management.

State agencies can also hire experts to reform administrative procedures, simplify online public service processes... At the same time, it is allowed to mobilize forces outside the payroll to establish, appraise, and supervise public investment projects, ODA or PPP...

The subjects signing contracts are not limited to retired cadres but prioritize experts, leading scientists, lawyers, typical businessmen... The selection process is assessed by the agency managing cadres and civil servants to ensure the candidate's capacity, reputation and achievements.

The Decree stipulates the corresponding time for each type of contract: up to 24 months for a labor contract and 36 months for a service contract. The cost of salary and remuneration is taken from the budget estimate, scientific research fund or other legal source approved by competent authorities.
