Clause 1, Article 15 of the 2025 Law on Teachers (effective from January 1, 2026) stipulates the reception of teachers in public educational institutions as follows:
Subjects considered for admission as teachers include cases accepted as civil servants according to the provisions of the law on civil servants and subjects enjoying the attraction and promotion policies prescribed in Article 25 of this Law.
In Decree No. 85/2023/ND-CP, cases accepted as civil servants are those who meet the standards and conditions of the job position, specifically as follows:
The first is that a person with 5 years or more of work in a professional or technical job suitable for the job position expected to be received at an agency, organization or unit established in accordance with the provisions of law.
The second is commune-level cadres and civil servants who are doing work in accordance with the job position expected to be received.
The third is those who have been cadres, civil servants, and public employees, and are then decided by competent authorities in writing to transfer to work at other agencies, organizations, and units but still do work in accordance with the expected job position.
The fourth is a doctoral degree or higher (recognized by a competent authority as prescribed) working at an agency or organization with a head office or branch established abroad or at a foreign agency or organization with a head office or branch established in Vietnam, with a training major suitable for the job position to be recruited and having worked for 3 years or more in professional and technical work suitable for the job position expected to be received.
The fifth is those with special talents and abilities suitable for job positions in the fields of culture, arts, physical education and sports, and traditional professions according to the regulations of the Ministry of Industry and field management.
The 6th is that students are admitted according to the regime prescribed by law, after graduating, they return to work in the locality where they are sent to study.
In addition, compared with Article 25, the subjects considered for admission as teachers include:
Highly qualified people, talented people, people with special abilities, people with high vocational skills;
People coming to work in ethnic minority areas, mountainous areas, border areas, islands and areas with particularly difficult socio-economic conditions;
Teachers perform the task of teaching, educating, and scientific research in a number of important and essential fields according to the needs of socio-economic development.
