In the report explaining, accepting and revising the draft Law on Teachers, the National Assembly Standing Committee said that there were opinions suggesting clearly defining the goals and time of summer vacation for teachers; there were opinions suggesting not to specifically regulate summer vacation to suit the specific nature of vocational education and higher education teachers.
The National Assembly Standing Committee said that it has accepted and directed the revision of regulations on teachers' summer vacation in an open direction, more clearly understanding the right to summer vacation and other holidays of teachers in Point d, Clause 2, Article 8; the annual summer vacation of teachers is arranged appropriately according to each level of education, training level and type of educational institution prescribed by the Government in Clause 3, Article 18.
Article 8 of the Draft Law on Teachers ( Latest edition) stipulates the rights of teachers as follows:
1. Teachers in public educational institutions exercise the rights prescribed by law on civil servants; teachers in non-public educational institutions and foreign teachers exercise the rights prescribed by law on labor.
2. In addition to the provisions of Clause 1 of this Article and the rights stipulated in relevant laws, teachers also have the following rights:
a) To be taught and educated in accordance with training expertise; proactively distribute time and arrange content according to educational programs; select and use documents and learning materials for teaching and education activities; comment, evaluate, participate in rewarding and disciplining learners according to regulations;
b) To conduct scientific research and transfer scientific research products according to the provisions of law on scientific research and intellectual property; participate in managing and operating enterprises established by higher education institutions, operating in the field of science development, application and technology transfer; enjoy preferential policies in scientific research activities according to the provisions of law;
c) To be respected and have their prestige and honor protected; to be treated equally in their activities and career development;
d) Having summer vacation and other holidays as prescribed;
d) Being trained and fostered to improve qualifications;
e) To participate in teaching and scientific research at other agencies, organizations and units according to the provisions of law and the regulations on the organization and operation of educational institutions.
