Ms. Nguyen Thanh Thuy (Hanoi) was admitted to the education sector in September 2020, currently an English teacher at a public high school.
Before being admitted, Ms. Thuy taught at a non-public high school, paying compulsory social insurance for 11 years and 6 months.
Ms. Thuy asked: "According to Decree No. 77/2021/ND-CP, am I entitled to seniority allowances as soon as I am admitted and appointed to the industry, or do I have to wait 5 years to join the state payroll to calculate? If I am entitled to it, how much percentage of my seniority allowance will I receive by now? ".

The Ministry of Education and Training responded to this issue on the Government Electronic Information Portal as follows:
The seniority allowance regime for teachers is implemented according to the provisions of Decree No. 77/2021/ND-CP dated August 1, 2021 of the Government. Accordingly, the time for calculating seniority allowances for teachers includes teaching and education time with compulsory social insurance contributions in public educational institutions (or non-public institutions if employees are subject to compulsory social insurance according to the provisions of the law on labor and education).
For teachers with teaching and education experience and who have paid compulsory social insurance for 5 years (60 months) will be entitled to seniority allowances equal to 5% of their current salary, plus leadership position allowances and seniority allowances exceeding the framework (if any). From the 6th year onwards, each year will be charged an additional 1%.
Ms. Nguyen Thanh Thuy was recruited as a civil servant in the education sector in September 2020, previously had a contract teaching period at a non-public school and had paid compulsory social insurance for 11 years and 6 months. Based on current regulations, she is allowed to accumulate this time to consider receiving seniority allowances.
When appointed to the professional title of teacher, regardless of the probationary period, if she has been teaching continuously for 5 years (or accumulated), she is eligible for seniority allowance as a teacher.
