In which, the implementation of job position changes for civil servants is based on Article 24.
Article 24. Implementing job changes for civil servants
1. Changes in leadership and management positions are implemented according to the decision of the competent authority on personnel work.
2. Change job positions with civil servant ranks higher in terms of expertise and profession than the current rank
a) The head of the competent authority managing civil servants decides or decentralizes or authorizes the establishment of a Council to assess the compliance with the standards and conditions of civil servants according to the plan to change the job position of the agency employing civil servants.
The Council's members include: The collective leadership, representatives of the Party Committee of the agency employing civil servants and other members decided by the head of the competent authority, the number of members selected by the Council must be an odd number. The Council only meets when 2/3 or more members are present. The Council works under a collective regime, decided by majority; in case of a simultaneous vote, the Council Chairman's vote will be followed. The Council meeting is recorded in minutes;
b) The head of the competent authority managing civil servants decides or decentralizes and authorizes the decision on changing job positions and ranking them according to the new job position for civil servants.
3. Change job positions with civil servant ranks of the same professional and technical ranks but different from the current rank.
The head of the agency employing civil servants shall decide according to his authority or propose to the competent authority to issue a decision to change the job position and rank the civil servant according to the new job position.
4. Change job positions with civil servant ranks according to professional and technical ranks lower than the current rank. The head of the agency employing civil servants shall decide according to his authority or propose to the competent authority to issue a decision to change the job position and rank the civil servant according to the new job position in the following cases:
a) Civil servants who do not meet the requirements of the task;
b) Civil servants who voluntarily apply to change to a job position with a civil servant rank rank ranked lower in terms of expertise and profession than the current rank.
In case there is no job position suitable for capacity, qualifications or a sufficient number of civil servants has been arranged according to the ratio of civil servants to be arranged according to each job position in the civil servant employment agency approved by competent authorities, the head of the competent authority shall decide to terminate the employment.
