Article 23 of the 2025 Law on Cadres and Civil Servants stipulates the positions of civil servants as follows:
- Based on job position determination:
+ Functions, tasks and organizational structure of agencies, organizations and units employing civil servants;
+ Complexity, nature, characteristics of each industry and field; scope, service subjects; professional and technical management process;
+ Level of modernization of offices, equipment, and working means; level of application of science, technology, digital transformation.
- The job position of civil servants includes the following main contents:
+ job position name;
+ corresponding position, title or civil servant rank;
+ Job description and job position capacity framework.
- Classification of job positions:
+ leadership and management job position;
+ Professional and technical job position;
+ Supported and served job position.
- The Government shall prescribe principles, order and procedures for the establishment and approval of job positions in accordance with the decentralization of management of cadres and civil servants in agencies of the Communist Party of Vietnam, the State, the Vietnam Fatherland Front, socio-political organizations and shall specify in detail this Article.
