Article 7. Rights and obligations on occupational safety and hygiene of employers
1. Employers have the following rights:
a) Require employees to comply with internal regulations, processes, and measures to ensure occupational safety and hygiene at the workplace;
b) Reward employees for good compliance and discipline employees who violate labor safety and hygiene;
c) Complaints, denunciations or lawsuits according to the provisions of law;
d) Mobilize workers to participate in emergency rescue, overcoming work-related incidents and accidents.
2. Employers have the following obligations:
a) Develop, organize implementation and proactively coordinate with agencies and organizations in ensuring occupational safety and hygiene at the workplace under their responsibility for employees and related people; pay occupational accident and disease insurance for employees;
b) Organize training and guidance on regulations, rules, processes, and measures to ensure occupational safety and hygiene; adequately equip means and tools for ensuring occupational safety and hygiene; perform health care, occupational disease detection; fully implement the regime for people who have occupational accidents or occupational diseases for workers;
c) Not to force employees to continue working or return to work when there is a risk of a work accident that seriously threatens the lives or health of employees;
d) Appoint people to supervise and inspect the implementation of internal regulations, processes, and measures to ensure occupational safety and hygiene at the workplace in accordance with the provisions of law;
d) Arrange departments or people working on occupational safety and hygiene; coordinate with the Executive Committee of the grassroots trade union to establish a network of occupational safety and hygiene workers; determine responsibilities and assign authority on occupational safety and hygiene work;
e) Conduct declaration, investigation, statistics, and reporting on occupational accidents, occupational diseases, and technical incidents that cause serious occupational insecurity and hygiene; compile statistics and report on the implementation of occupational safety and hygiene work; comply with the decisions of specialized inspectors on occupational safety and hygiene;
g) Consult the Executive Committee of the grassroots trade union when developing a plan, rules, processes, and measures to ensure occupational safety and hygiene.
