Article 19 of Decree No. 131/2025/ND-CP stipulates the authority of the Chairman of the People's Committee at the commune level in the field of dykes and natural disaster prevention as follows:
1. Mobilize forces, materials, and means to protect dykes according to the provisions of Point b, Clause 2, Article 35, decide on land use for a term according to the provisions of Point d, Clause 2, Article 35 of the Law on Dikes, which has been amended and supplemented in the Law amending and supplementing a number of articles of the Law on Natural Disaster Prevention and Control and the Law on dykes.
2. Mobilizing resources to serve natural disaster response activities as prescribed in Clause 1, Article 28 of the Law on Natural Disaster Prevention and Control, which has been amended and supplemented in the Law amending and supplementing a number of articles of the Law on Natural Disaster Prevention and Control and the Law on Dikes.
3. Response to level 1 natural disaster risks as prescribed in Clauses 3, 4 and 5, Article 7; respond to level 2 natural disaster risks as prescribed in Clause 3, Article 8; respond to level 3 natural disaster risks as prescribed in Clause 5, Article 9; respond to level 4 natural disasters as prescribed in Clause 6, Article 10 of Decree No. 66/2021/ND-CP dated July 6, 2021 of the Government detailing the implementation of a number of articles of the Law on Natural Disaster Prevention and Control and the Law amending and supplementing a number of articles of the Law on Natural Disaster Prevention and Control and the Law on dykes.
4. The decision to support funding for medical examination and treatment, accident benefits (except for cases of accident benefits that reduce working capacity by 5% or more) for participants in the commune-level disaster prevention and control shock force is stipulated in Point b, Clause 4, Article 35 of Decree No. 66/2021/ND-CP dated July 6, 2021 of the Government detailing the implementation of a number of articles of the Law on Natural Disaster Prevention and Control and the Law amending and supplementing a number of articles of the Law on Natural Disaster Prevention and Control and the Law on Dikes.
The order and procedures for implementation are specified in Section 1, Appendix V issued with this Decree.
5. Receive, prepare documents, and submit to the Chairman of the Provincial People's Committee for decision on accident subsidy that reduces working capacity by 5% or more or causes death for participants in the commune-level disaster prevention and control shock force as prescribed in Point b, Clause 4, Article 35 of Decree No. 66/2021/ND-CP dated July 6, 2021 of the Government detailing the implementation of a number of articles of the Law on Natural Disaster Prevention and Control and the Law amending and supplementing a number of articles of the Law on Natural Disaster Prevention and Control and the Law on Dikes.
The order and procedures for implementation are specified in Section 2 of Appendix V issued with this Decree.
6. Allocate land and arrange accommodation for households that need to be relocated, decide to mobilize funds, forces, equipment, materials and related organizations and individuals according to the authority prescribed in Clause 3, Article 19 of Decree No. 66/2021/ND-CP dated July 6, 2021 of the Government detailing the implementation of a number of articles of the Law on Natural Disaster Prevention and Control and the Law amending and supplementing a number of articles of the Law on Natural Disaster Prevention and Control and the Law on Dikes.
7. The decision to exempt contributions for subjects as prescribed in Clause 2, Article 14 of Decree No. 78/2021/ND-CP dated August 1, 2021 of the Government on the establishment and management of the Natural Disaster Prevention and Control Fund has been amended and supplemented with a number of articles in Decree No. 63/2025/ND-CP dated March 5, 2025 of the Government.
