In which, the order and procedures for appointing civil servants in leadership and management positions under the management authority of ministries, branches and localities are based on Article 33.
Article 33. Procedures for appointing civil servants in leadership and management positions under the management authority of ministries, branches and localities.
1. For appointment policy:
a) The collective leadership and Party committees of agencies, organizations and units that need to appoint civil servants to lead and manage the project shall submit to the competent authority for appointment a policy in writing, clearly stating the number of positions and titles that need to be improved, the expected human resources for appointment and the expected assignment of specific fields and tasks;
b) No later than 15 working days from the date of receipt of the proposal, the competent authority appointing the person must review and decide on the appointment policy, clearly defining the expected personnel source for appointment and other contents (if any);
c) No later than 30 working days from the date of receipt of approval on the appointment policy, the agency, organization or unit must complete the implementation of the personnel process according to regulations. In case it is not completed, the agency, organization or unit must report to the competent authority to appoint for consideration and direction.

Selection principle: The person with the highest score of over 50% of the nomination documents will be selected for appointment. In case 02 people with the same number of votes have reached 50% of the nomination votes, the head will consider and select personnel to propose the appointment; at the same time, fully report different opinions to the competent authority for consideration and decision.
The head of the agency, organization or unit shall issue a decision on appointment according to his authority or submit it to the competent authority for consideration and decision according to regulations.

4. Based on the specific conditions of agencies and organizations, Ministers, Heads of ministerial-level agencies, heads of organizations established by the Government and the Prime Minister but not public service units, Chairmen of People's Committees of provinces and centrally run cities shall specify the authority, procedures for appointment, and responsibility for organizing meetings at each step; decide on specific participants in the process of appointing leadership and management positions and titles under their authority, ensuring compliance with the principles prescribed by competent authorities, as prescribed in this Decree and other relevant regulations.
