Youme Law Firm LLC said that according to Section 2 of Instruction 01/HD-UBND in 2025 of the Hanoi People's Committee, the principles of assessment for cadres, civil servants, public employees and workers to implement the arrangement of the apparatus, streamline the payroll and restructure, improve the quality of cadres and civil servants and resolve policies and regimes are as follows:
- Comply with the provisions of Decree 178/2024/ND-CP, Decree 67/2025/ND-CP and Instruction 01/HD-UBND in 2025.
- Link the assessment with streamlining the payroll, restructuring, and improving the quality of the staff, civil servants, and public employees of each agency, organization, and unit in the process of restructuring the apparatus.
- The assessment is carried out according to the criteria of each job position group in accordance with the characteristics of the situation and practice of the agency, organization, or unit.
- The assessment results are calculated on a 100-point scale based on the results of performing tasks in the last 3 years. The total scores for each cadre, civil servant, public employee, and worker are arranged in order from high to low...
- Consider and evaluate immediately after the merger and consolidation:
+ The settlement of early retirement or termination of employment in cases of voluntary application must be agreed upon by the head of the agency, organization or unit according to regulations. If they do not agree, the head of the agency, organization or unit must respond in writing and state the reason.
+ Do not consider or resolve cases of voluntary applications for early retirement or resignation but are assessed as having outstanding qualities and abilities, daring to think, daring to do, daring to take responsibility for the common good, having outstanding achievements, bringing benefits to agencies, organizations, and units.
+ In case the head of an agency, organization or unit has issued a document not agreeing to early retirement or termination of employment for cadres, civil servants, public employees, and workers who have submitted a voluntary application for retirement, but the cadres, civil servants, public employees, and workers still wish to retire, the competent authority shall immediately resolve the termination of employment and will not enjoy the regime according to Decree 178/2024/ND-CP and Decree 67/2025/ND-CP.
- On the basis of the number of people who have voluntarily resigned from competent authorities to agree, from the evaluation results, agencies, organizations and units continue to determine the number of people who need to consider streamlining to meet the criteria of 25% reduction in the number of cadres, civil servants, officials and employees in accordance with the central regulations, ensuring the principle of streamlining those who have the lowest assessment results from the bottom up.
- In addition to the target of reducing 25% of cadres, civil servants, and public employees, agencies, organizations, and units can base on the results of the assessment to continue screening to improve the quality of the team to meet the requirements of assigned tasks.
- For cadres, civil servants and public employees who have not met the training standards after the organizational arrangement; professional degrees that do not match the job position requirements approved by competent authorities, agencies, organizations and units shall consider and evaluate to resolve policies according to regulations.
Thus, payment will not be considered and resolved for cases where civil servants and public employees who voluntarily retire before the age are assessed to have outstanding qualities and abilities, dare to think, dare to do, dare to take responsibility for the common good, have outstanding achievements, and bring benefits to the agency, organization, or unit.
