Every time Tet comes, the topic of returning home for Tet is of great interest to many people. Many wives complained because their husbands were upset, even not letting his wife go to the parents' house.
Regarding this issue, Clause 1, Article 55 of Decree 144/2021/ND-CP of the family marriage law stipulates that the following acts will be subject to warning or fines:
1. A warning or a fine of VND 5,000,000 to VND 10,000,000 for one of the following acts:
a) Prohibiting family members from leaving the home, preventing family members from meeting relatives, friends or having legitimate, healthy social relationships for the purpose of isolation, causing frequent psychological pressure on that family member...
b) Not allowing family members to exercise their right to work;
c) Not allowing family members to participate in legal and healthy social activities.
Returning to their hometown for Tet is also a legitimate occasion for the wife to meet family, relatives and friends. However, not all cases of husbands not letting their wives return to their hometowns for Tet are punished. The above regulation will only apply if the ban on allowing a wife not to return to her hometown to meet relatives and friends for the purpose of isolation, causing frequent psychological pressure on the wife.
Thus, going back to her maternal hometown for Tet is very legitimate, so if she bans her husband and puts psychological pressure on the wife when the wife wants to go back to her maternal hometown for Tet, the husband will be punished.
The behavior of abusing and pressuring his wife from this year will also be punished higher. Specifically, from January 1, 2022, administrative violations in the field of family marriage will be punished according to the new regulations in Section 4 of Decree 144/2021.
- Fine from VND 5,000,000 to VND 10,000,000 for the act of beating up causing injury to a family member.
- Fine from VND 10,000,000 to VND 20,000,000 for one of the following acts:
+ Using tools, means or other items to cause injury to family members;
+ Not promptly taking the victim to the emergency room for treatment in cases where the victim needs timely emergency care or not caring for the victim during the victim's treatment of injuries caused by domestic violence, unless the victim refuses.
+ Bad treatment of family members such as: fasting, drinking, being cold, wearing torn clothes, not giving or limiting personal hygiene;
+ Abandoning care for family members is pregnant women, women raising young children...
- Fine from 5 - 10 million VND for acts of insult, payment, insulting the honor and dignity of family members.
- A warning or a fine of 5 - 1 million VND for one of the following acts:
+ Not allowing family members to exercise their right to work;
+ Not allowing family members to participate in legal and healthy social activities.
