On the occasion of the long Lunar New Year holiday, many families proactively arrange plans to reunite or rest after a busy year. Some families take their children back to their hometown to celebrate Tet with their grandparents, keeping the traditional reunion atmosphere intact. Some families choose cross-Tet trips to change the wind and enjoy time together.
However, not every family has enough full holidays, as in many families, family members have to work throughout Tet due to the specific nature of work. On-duty shifts and business trips on the first day of the year are compensated with salaries and bonuses, as a way to share and acknowledge silent sacrifices to maintain the pace of operation for society.
So, how are workers who go to work during the Lunar New Year holiday paid?
Answering Lao Dong Newspaper, Lawyer Vu Van Tuan - Director of Nam Thanh Nam Law Company (Hanoi Bar Association) said that the law stipulates the payment of increased salaries to workers going to work on Tet.

According to point b, clause 1, Article 112 of the 2019 Labor Code, employees are entitled to 5 days of full-time leave and salary during the Lunar New Year. However, if they go to work on Tet, employees will be paid overtime wages many times higher than the normal day's salary.
Article 98 of the Labor Code stipulates:
1. Overtime workers are paid according to the unit price of salary or the actual salary paid according to the work they are doing as follows:
a) On weekdays: at least 150%;
b) On weekly holidays: at least 200%;
c) On holidays, Tet holidays, paid holidays, at least equal to 300% excluding the salary on holidays, Tet holidays, paid holidays for employees receiving daily wages.
2. Workers working at night are paid an additional amount of at least 30% of the salary calculated according to the salary unit price or the actual salary paid according to the workload of a normal working day.
3. Workers who work overtime at night, in addition to paying salaries according to the provisions of Clauses 1 and 2 of this Article, are also paid an additional 20% of salary calculated according to the unit price of salary or salary according to the work done during the day of normal working days or weekly holidays or holidays, Tet holidays.
Based on the above regulations, if including the salary when taking leave, employees going to work during the 5 days of Tet Nguyen Dan will receive at least 400% of the salary of a normal working day if working during the day and 490% of the salary of a normal working day if working at night.
Thus, instead of reuniting with their families, workers will be compensated worthily with a salary many times higher if they go to work during Tet. Reunion Tet, although coming later, is more fulfilling and prosperous.
