Mr. Nguyen Van Xuan said that from September 2014 to October 2022, he worked at the Ward People's Committee as an Economic charge officer (non-professional cadre).
In October 2022, he participated in a civil servant recruitment exam at the City Investment and Trade Promotion Center, passed the entrance exam and has worked at this Center until now.
During his working period, Mr. Xuan participated in social insurance at the Ward People's Committee for 8 years and 1 month and at the Trade and Investment Promotion Center for 3 years and 1 month.
Thus, his total working time with social insurance is 11 years and 2 months, including 8 years and 1 month as a non-professional cadre and 3 years and 1 month as a civil servant.
Pursuant to Decree No. 170/ND-CP dated June 30, 2025 of the Government on recruitment, use and management of civil servants (Article 4, Article 13, Article 14), he requested the Ministry of Home Affairs to inform whether in his case there are sufficient conditions to transfer from civil servant to civil servant or not.
Regarding Mr. Xuan's reflection on the proposal, the Ministry of Home Affairs responded on the Electronic Information Portal.
Regarding standards and conditions for being accepted as civil servants, they have been specifically stipulated in Clause 3, Article 13 of Decree No. 170/2025/ND-CP dated June 30, 2025 of the Government regulating the recruitment, use and management of civil servants.
In which, there is a provision: "In the cases specified in Points b, c, d, e, g and h, Clause 1 of this Article, there must be 5 years of work or more in accordance with the provisions of law, and compulsory social insurance contributions (if not continuous and have not received a one-time social insurance subsidy, it will be accumulated, including the working time if there was a previous job position specified in Points b, c, d, dd, e, g and h, Clause 1 of this Article), doing a job with professional and technical requirements suitable for the job in the expected job position".
Accordingly, being accepted as a civil servant must meet the standards and conditions of the expected job position in accordance with the above regulations.
