According to Article 2 of Decree 29/2023/ND-CP, teachers who are civil servants are subject to staff reduction in the following 8 cases:
Surplus due to review and rearrangement of organizational structure and personnel according to the decision of competent authority or surplus due to public service units rearranging organizational structure and personnel to implement the autonomous mechanism;
Redundancy due to restructuring of civil servants according to job positions, but cannot arrange or assign other jobs or can arrange other jobs but teachers voluntarily reduce staffing and are approved by the agency, organization or unit directly managing them;
Teachers who have not yet achieved the training level according to the professional and technical standards prescribed for the job position they are holding, but there is no other suitable job position to arrange and cannot be arranged for retraining to standardize their professional and technical skills, or are arranged for other jobs by the agency but the teacher voluntarily implements staff streamlining and is agreed by the agency, organization or unit directly managing them;
There are 2 consecutive years at the time of considering streamlining the payroll, the teacher has 1 year of quality classification at the level of completing tasks and 1 year of not completing tasks but cannot be arranged for other suitable jobs; in the previous year or in the year of considering streamlining the payroll, the quality classification is at the level of completing tasks or lower but the teacher voluntarily implements streamlining the payroll and is agreed by the agency, organization, or unit directly managing;
There are 2 consecutive years at the time of considering streamlining the payroll, in each year the total number of days off work is equal to or higher than the maximum number of days off work due to illness as prescribed in Clause 1, Article 26 of the Law on Social Insurance, with confirmation from the Social Insurance agency paying sickness allowances according to current regulations of law; in the previous year or in the year of considering streamlining the payroll, the total number of days off work is equal to or higher than the maximum number of days off work due to illness as prescribed in Clause 1, Article 26 of the Law on Social Insurance, with confirmation from the Social Insurance agency paying sickness allowances according to current regulations of law, the teacher voluntarily implements streamlining the payroll and is approved by the agency, organization or unit directly managing him/her;
Teachers are leaders and managers who cease to hold positions and titles due to the reorganization of the apparatus and administrative units according to the decision of competent authorities; teachers voluntarily reduce staffing and are approved by the agency, organization or unit directly managing them;
Teachers who are being disciplined but not to the extent of being dismissed or forced to quit according to the provisions of law at the time of considering streamlining the payroll, individuals who voluntarily carry out streamlining the payroll, with the consent of the agency, organization, or unit directly managing them.
According to the data on streamlining audits up to October 15, 2018 and the data on streamlining audits up to June 30, 2022 of the Ministry of Home Affairs, the data on streamlining of ministries, branches and localities to date is 79,024 people (ministries, branches: 5,510 people; localities: 73,5134 people).
