The Ministry of Education and Training (MOET) is seeking opinions on the draft Decree detailing a number of articles of the Law on Teachers. In which, the regulation on assessing teachers according to professional standards in Article 30 is assessed as a content that has a direct and long-term impact on the teaching staff and lecturers throughout the education system.

Taking competence as a measure

According to the draft Decree, teachers in educational institutions are assessed for the level of meeting the standards for professional and nghiep vu competence according to the professional standards of the title of teacher. The evaluation criteria are not set by each institution itself, but are based on the unified guidance of the Minister of Education and Training.

This regulation aims to ensure synchronization throughout the system, overcoming the situation of formalistic assessment or application in different places. Focusing on professional capacity is also in line with the spirit of the Law on Teachers, considering the quality of performing teaching and educational tasks as a core factor.

Another new point is that the results of professional standard assessment will be used as a basis for evaluating teachers according to the provisions of Clause 1, Article 22 of the Law on Teachers. This shows that professional standard assessment is no longer a "internal evaluation" step for reference, but has become a legal basis in the official evaluation process for teachers.

According to Clause 1, Article 22 of the Law on Teachers, the assessment of teachers is carried out to serve as a basis for ranking the quality of teachers; arranging, using; training, fostering; as well as considering commendation and discipline for teachers. Thus, when the professional standard assessment results are used for these purposes, the professional standard will directly affect the job position, development opportunities and rights of teachers.

Clear distinction between public and non-public establishments

The draft Decree also clearly stipulates the method of organizing assessments for each type of educational institution.

For public educational institutions, the time, order, procedures for evaluation, classification and use of teacher evaluation results are implemented according to the provisions of the law on civil servants. This approach ensures consistency between the Law on Teachers and the Law on Civil Servants, avoiding overlapping in the implementation process.

Meanwhile, non-public educational institutions are entitled to develop and implement the Regulation on evaluating and ranking teachers under their management, based on the actual conditions of the unit and the guidance of the Ministry of Education and Training. This regulation both ensures a common legal framework and respects the autonomy of non-public educational institutions.

Clarify the responsibilities of heads of educational institutions

Article 30 of the draft Decree reserves an important content to stipulate the responsibilities of heads of public educational institutions. Accordingly, principals and directors of educational institutions must base on the specific conditions of the unit to provide detailed guidance on tasks according to each teacher title; arrange and assign tasks suitable to the specific characteristics, promote the capacity and strengths of each teacher; and at the same time organize the assessment of the level of meeting professional standards as a basis for ranking teacher quality.

This regulation shows that assessment is not only the responsibility of teachers, but also associated with the management and implementation responsibility of the head. If the assessment is not objective, formalistic, or does not accurately reflect the teacher's capacity, the responsibility first and foremost lies with the leaders of the educational institution.

The new regulations in Article 30 of the draft Decree show the direction of assessing teachers according to professional standards in a substantive way, with clear legal and management consequences. When the assessment results are directly linked to classification, use, training and commendation, discipline according to the Law on Teachers, professional standards will no longer be "criteria for sufficient dossiers", but become a mandatory requirement for each teacher.
