The above content is stipulated in the Draft Circular regulating the working regime for preschool teachers that the Ministry of Education and Training is soliciting comments on. This draft Circular replaces the current Circular No. 48/2011/TT-BGDDT (Circular No. 48).
Clarifying the working hours of preschool teachers
Regarding working time, the draft Circular clarifies the working time of preschool teachers implemented according to the school year and converted to teaching hours. This includes the number of teaching hours per day according to the teaching hours standard to ensure compliance with the professional activities of preschool teachers, unified and synchronized with the circulars regulating the working regime of teachers at other levels and levels.

At the same time, preschool teachers' working hours are supplemented in addition to direct teaching in class, preparation time for teaching in class, time to perform other professional work according to professional requirements, and time to pick up and drop off children to ensure that they are suitable for the professional activities of preschool teachers.
The draft Circular also adjusts the time limit for teachers teaching groups of children and kindergartens 2 sessions/day that must teach directly in class from 6am in Circular No. 48 to 5:30am (excluding the time for picking up and dropping off children). This regulation aims to separate the time spent teaching directly in class from the time spent welcoming and dropping off children so that preschools can facilitate the assignment and assignment of tasks to teachers.
Each preschool teacher cannot concurrently hold more than 2 tasks
The draft Circular stipulates that principals and deputy principals must directly participate in teaching children to grasp the content and goals of the curriculum, instead of the regulation that principals and deputy principals can teach children or attend children's lessons of teachers in schools in Circular No. 48. This regulation aims to improve the effectiveness of leadership and management in preschool education institutions.
The draft Circular clearly states that each teacher must not concurrently hold more than 2 tasks to ensure that teachers focus on the tasks of nurturing, caring for, educating, and protecting children. At the same time, the draft stipulates that for tasks that have received remuneration or allowances, they cannot be converted to teaching hours to avoid paying overlapping regimes and policies for the same 01 task, ensuring consistency with regulations on payment of overtime teaching wages.
The draft Circular supplements regulations on the regime of reducing teaching hours for teachers who concurrently hold a number of job positions such as supporting the education of people with disabilities, clerical and library staff. This regulation aims to ensure the regime for teachers to retain job positions as stipulated in Circular No. 19/2023/TT-BGDDT on guidance on job positions, the structure of civil servants according to professional titles and the number of employees in public preschools.
Add some professional activities converted to teaching hours
The draft Circular clearly stipulates the case where maternity leave (for female teachers) coincides with summer vacation. Accordingly, in the case of female teachers whose maternity leave coincides with the annual summer vacation but the remaining annual summer vacation (if any) is less than the annual leave as prescribed by the Labor Code, teachers will be arranged to take an additional number of days off, ensuring the total number of days off is equal to the number of days off per year as prescribed by the Labor Code.
In addition to professional activities that have been converted to teaching hours according to the provisions of Circular No. 48, the draft Circular adds a number of other professional activities that have been converted to teaching hours to ensure the rights of teachers and to be consistent with the operations of preschool education institutions.
In particular, there are clear regulations on conversion for teachers participating in daycare at noon who have not received remuneration, the principal of the school should base on the number of children staying in the boarding house and the time of daycare at noon to specifically determine the conversion of teaching hours but not exceeding 2 hours of teaching after receiving a consensus from the school's pedagogical council.
The draft Circular supplements cases where compensatory teaching is not required and the number of allocated periods is included, including cases where teachers are on leave for medical examination and treatment (not exceeding the prescribed time) with the school principal's consent and with confirmation of medical examination and treatment from the medical facility.
Abolish some regulations on reducing teaching hours for members of the School Council and the Executive Committee of trade unions to comply with current regulations on abolishing School Councils and trade unions in public educational institutions.
