Ms. Nguyen Thi Phuong Linh's husband (Vinh Long) is a Music teacher, working at a junior high school for 21 years, professional title of Grade II junior high school teacher, code V.07.07.04.31, salary level 3, coefficient 4.68 from November 1, 2023.
In July 2024, Ms. Phuong Linh's husband was transferred to work as a Music teacher at a primary school until now and has not changed his professional title.
Recently, her husband was informed that he would not be able to increase his seniority allowance and salary coefficient. Ms. Phuong Linh asked the authorities to answer about her husband's case.

The Ministry of Education and Training provides the following guidance:
Clause 1, Article 32 of the Law on Public Employees stipulates: "When a public service unit has a need, a public employee can be transferred to a new job position if he meets the professional and technical standards of that job position".
Therefore, when her husband was given the authority to change from the position of junior high school teacher to a primary school teacher teaching Music, he met the professional and technical standards of the primary school teacher position.
At the same time, Point a, Clause 1, Article 31 of the Law on Civil Servants stipulates: "Working in a job position, you will be appointed to the professional title corresponding to that job position". Therefore, when Ms. Linh's husband was transferred to teach Music at a primary school, he had to be appointed to the professional title of primary school teacher.
The transfer of the professional title of teacher is implemented in accordance with the Government's regulations in Article 30 of Decree No. 115/2020/ND-CP and ensures the principles specified in Clause 5, Article 5 of Circular No. 08/2023/TT-BGDDT. Her husband needs to provide the Principal with documents so that the Principal can propose to the competent authority to carry out the transfer of professional titles.
In addition, according to Point a, Clause 1, Article 3 of Decree No. 77/2021/ND-CP, the period to be calculated for seniority allowances for teachers includes: "Teaching and education period with compulsory social insurance payment in public educational institutions".
Thus, her husband's entire teaching period with compulsory social insurance contributions, whether in the professional title of junior high school teacher or primary school teacher, is included in the seniority allowance for teachers.
