The Ministry of Education and Training said that it has just received a question from Ms. N.T. H related to Circular No. 13/2024/TT-BGDĐT regulating standards and conditions for considering promotion to professional titles of preschool and general education teachers.
Ms. H said that she signed a teaching contract at the school in August 2012, and in January 3, 2017, she officially passed the civil servant exam at the school, and was appointed to CDNN rank 3 - V07.04.12.
When Circular No. 03/2021/TT-BGDĐT took effect, because Ms. H did not have a university standard level as required, she continued to hold rank 3-V07.04.12. Then was sent to study to improve the university standard level of History pedagogy according to the local roadmap.
As of December 3, 2024, Ms. H has been granted a bachelor's degree but has not been considered for a new grade 3, which is V.07.04.32. Until July 1, 2025, Ms. H will be considered for a new grade 3, which is V.07.04.32. Currently, Ms. H's locality is considering a new grade 2 promotion project, Ms. H has met all the criteria for promotion, but currently the problem is: In the criteria for promotion consideration, the time holding the rank of a subordinate professional title is recorded as at least 12 months up to the time of submitting the application.
I hope the Ministry of Education and Training will answer so that we can have time to consider the new rank 2 promotion dossier" - Ms. H stated.
Regarding the content, the Ministry of Education and Training said that according to the regulations on the time of holding a lower rank adjacent to the rank registered for consideration in point k, clause 4, Article 4 of Circular No. 03/2021/TT-BGDĐT amended and supplemented in Circular No. 08/2023/TT-BGDĐT, the Ministry of Education and Training does not require teachers transferring from old professional titles or old teacher ranks or civil servant ranks... to new professional titles to have at least 12 months of holding a professional title rank adjacent to the rank of professional title for consideration up to the deadline for submitting applications for promotion consideration.
If Ms. H's information is accurate, then she was appointed to the professional title of secondary school teacher rank III (code V.07.04.12) from January 2017, and was appointed to the professional title of secondary school teacher rank III (code V.07.04.32) from July 2025, up to the present time she has held rank III for more than 9 years (code V.07.04.32) and equivalent. That is, she has met the standards for the time holding rank lower than the adjacent one specified in point k, clause 4, Article 4 of Circular No. 03/2021/TT-BGDĐT amended and supplemented in Circular No. 08/2023/TT-BGDĐT to register for consideration for promotion to the professional title of secondary school teacher rank II (code V.07.04.31).
Ms. H's case does not need to take into account the working time before recruitment and reception at point d, clause 1, Article 32 of Decree No. 115/2020/ND-CP amended and supplemented in Decree No. 85/2020/ND-CP.
